Members of the Waterlefe Master Property Owners’ Association are granted access to several amazing amenities and services provided by the dedicated staff that keep Waterlefe great. Your membership includes access to the River Club and all it has to offer including the Tiki Bar, Community Pool, Fitness Center, Library, and activities at the Pointe. The following New Membership Registration Packet is designed to facilitate the seamless transition of new members into the Waterlefe community and its associated systems. Membership Card As members of the association, you will be issued membership cards that provide identification, access to amenities/pedestrian gates, and a convenient payment method in the River Club. A favorite MPOA amenity is our Fitness Center, located on the ground floor of the River Club. Your membership card will also provide 24/7 access, once you have signed and returned the fitness waiver (included). Boat Registration Boat registration is required for all boat owners. If you do not own a boat at this time, you do not need to complete the registration form, however if you purchase a boat in the future, please register the vessel with the Association. Pet Registration We ask for your pet information in order to be of assistance in identifying a loose pet in the neighborhood. The association does not limit the breed or size of dogs, however, there is a limit of three pets allowed per household. Per county ordinance and Waterlefe Covenants, you must pick up after your pet and always have them on a leash whenever outside your unit. Waterlefe Member Central Registration This packet includes helpful instructions on how to register on the official Waterlefe website, https://waterlefemembers.com/. You will have access to a community roster, calendar of events, MPOA monthly statement, community news, and much more. I encourage you to register and take advantage of this very helpful resource. Reference # _________ Page 8 of 15 MPOA CHARGES AND PAYMENTS As a member of the Waterlefe MPOA, homeowners are responsible for paying assessments according to the section of the community you live in. Everyone living in Waterlefe pays the same base MPOA assessments through quarterly payments. Depending on the sub-association or area that a homeowners lives in (Villas, Shores, Sound, Watch, Watch II), they may be responsible for additional fees from the sub-association. Spectrum Internet & TV MPOA assessments include a wide array of facility and management services for homeowner convenience. One of such services is a bulk contract with Spectrum that gives Waterlefe homeowners access to cable TV and internet, funded by MPOA assessments. Annual Minimum In addition to the association assessments and dues, homeowners also have an annual River Club minimum they are responsible for meeting through charges at the River Club and its associated dining facilities. The annual minimum amount is set annually. Currently, the minimum is $500 per year and includes all food and beverages purchased in the River Club Dining Room, Bistro, and Tiki Bar. These purchases include alcohol purchased, but the minimum does not include tax and gratuity. Please keep in mind you must spend this minimum by December 31st in order to avoid an additional assessment for the remaining balance.

Reference # _________ Page 10 of 15 FITNESS CENTER DISCLOSURE, WAIVER, AND RELEASE OF LIABILITY AGREEMENT – COVID-19 Preface: Please read the following carefully as you are giving up important legal rights and being requested by Waterlefe Master Property Owners Association, Inc. (“MPOA”) to disclose any serious health conditions that may prevent you from re-entering Fitness Center and confirming upon you the responsibility of complying with the MPOA’s policies and procedures related to the new social distancing, safety, and sanitation standards. Disclosure(s): In order to continue using the Fitness Center and pool, you have a duty to disclose and must advise Management if you have any symptoms related to COVID-19, including, but not limited to the following: cough, shortness of breath or difficulty breathing, fever, chills, muscle pain, sore throat, new loss of taste or smell. Should you disclose to the MPOA any of the foregoing symptoms, you will not be allowed re-entry into the Fitness Center until you provide positive proof of testing negative for COVID-19. Additionally, at any point, should you display any of the foregoing COVID-19 symptoms, you will be asked to leave and not be allowed re-entry into the Fitness Center until such time as you provide positive proof of testing negative for COVID-19. Confirmation of MPOA’s Policies and Procedures: You acknowledge and accept the MPOA’s Policies and Procedures, a copy of which is attached hereto as Exhibit “A” and incorporated herein by reference. Said policies and procedures comply with new social distancing, safety, and sanitation standards promulgated by the Center for Disease Control (CDC), Florida Department of Health, and Manatee County. Should you fail to adhere to any of said policies and procedures, you will not be provided re-entry into the Fitness Center and your rights to use the Fitness Center will be revoked immediately and indefinitely. Additionally, you acknowledge and accept that any deviation from said policies and procedures is of your own accord and all corresponding consequences shall be borne exclusively by you. MPOA maintains a zero-tolerance policy for any indirect or direct disregard for said policies and procedures. As such, it will act accordingly to ensure the safety and health of the Waterlefe community. Your Express Assumption of Risk: By signing the below, in consideration of being allowed to use the Fitness Center, and in acknowledging and accepting the MPOA’s new policies and procedures related to social distancing, safety, and sanitation, you, yourself, but also your heirs, executors representatives, agents, successors, assigns, and administrators (“Releasor”) as participant, hereby agree and acknowledge that you are fully aware that use of the Fitness Center involves risk, both direct and inherent, and you accept the risk of participating, even if the risks are created by the negligence of the MPOA, its directors, officers, employees, agents, and attorneys (hereinafter “Released Parties”).

Reference # _________ Page 11 of 15 You understand and are fully aware that there are significant risks, known and unknown, involved in all aspects of your use of the Fitness Center and that many of these risks are essential to the activity of the Fitness Center, and therefore, cannot be eliminated. You understand that these risks include bodily injury ranging from minor sprains to death and disfigurement and include but are not limited to: contracting COVID-19 or spreading COVID-19 to other members of the MPOA, staff of the MPOA, friends, families, and/or the general public. Such risks could result in minor injury, serious injury or even death; injury or death due to negligence on the part of yourself or other people around. You understand that an injury may impair your or another’s future ability to earn a living, to engage in business, social and recreational activities, and to generally enjoy life. You agree that your use is VOLUNTARY and based on your independent assessment of the risks involved you assume full responsibility for the risks that you are exposing yourself to and accept full responsibility for any injury or death that may result from your use of the Fitness Center. * * * * * * Release of Claims and Liability and Indemnification Agreement: I have read and understand the foregoing Express Assumption of Risk, and Release of Liability and I understand that by signing it I am obligated to indemnify the Released Parties (the MPOA, its directors, officers, employees, agents and attorneys, as referred herein) named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission(s) or the negligent or intentional act or omission(s) of the Released Parties, this would include, but is not limited to my departure from MPOA policies and procedures in compliance with social distancing, safety, and sanitation. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless the Released Parties from any and all claims, demands, or causes of action, which are in anyway connected with participation in the class, including any such claims, which allege negligent acts or omissions of the Released Parties. I accept sole financial and legal responsibility for myself in the event of injury or illness (related or unrelated to COVID-19) that I suffer or for which I am legally responsible for to a third-party and agree to indemnify and defend the Released Parties from any and all claims, demands, damages, loss of service, or expense for property damage and for personal injuries or actions brought by a third-party against Released Parties resulting or arising from my participation in the above-described class for my use of the facility in which the class is held. I accept sole financial and legal responsibility for property damage, lost equipment, or any participation I may have directly or indirectly caused to another related or unrelated to COVID-19. I understand that by signing this form I am waiving valuable legal rights. Attorney’s Fees and Costs: I agree to pay full reasonable attorney fees and litigation expenses incurred by any person, real or corporate, whom I may sue to challenge this Agreement. The sole and exclusive venue for any litigation arising from or related to this Agreement shall be the Circuit Court of Manatee County, Florida. This agreement shall be interpreted according to the laws of the State of Florida. I understand that my agreement to pay attorney’s fees and litigation expenses is an essential condition for my use of the Fitness Center. If any provision of this Agreement shall be deemed by the court to be invalid, the remainder of this Agreement shall remain in full force and effect. I also certify with my

Automatic Termination: Should you fail to abide by the policies and procedures promulgated by MPOA for the Fitness Center in compliance with state, county, and local government standards of social distancing, safety, and sanitation, your rights to use the Fitness Center shall be immediately terminated by the Board for a period of time to be determined by the Board. Reference # _________ Page 13 of 15 GUIDELINES FOR USE OF THE FITNESS CENTER To ensure that the use of the Fitness Center continues to provide a fun, healthy and enjoyable experience for all, please show courtesy and respect to other participants by abiding by the following guidelines: • Use of the Center is restricted to Waterlefe employees and residents age 16 and older. Residents under the age of 16 must be accompanied by an adult resident. Guests must be accompanied by a Waterlefe resident. • Each member must have a signed liability waiver with the River Club management prior to using the Fitness Center. • New members are strongly encouraged to schedule a fitness orientation with a personal trainer before using the Fitness Center. • Please sign in every time you work out. • Cell phone use in the Fitness Center is prohibited. Please set phones on “vibrate” or “mute” if you must have a phone in the Fitness Center. Please make and answer calls outside. • Television usage is limited to earphones or closed captioning. Open audio is not permitted. • Proper hygiene is required. Please wipe down the machines after each use. Antibacterial spray and paper towels are provided Please limit the use of cologne and perfumes as they may cause allergic reactions in others. • Please use appropriate clothes and workout towels. Shirts and dry, closed-toed athletic shoes are required. • Please limit time on cardio machines to 30 minutes when all machines are in use and others are waiting. • Pick up after yourself. Please return free weights and equipment to the original position/racks. Use equipment properly. Do not sit on equipment between sets. Please allow others to exercise on machines and with the weights between your sets. • Please do not slam, drop, clang, or throw weights on the floor when you are finished exercising. • Please use the exercise studio (across the hall), when available, for stretching or conducting yoga-style exercises. Mats should be returned to the storage rack. Lying on the floor near free weights is dangerous. • Food is not allowed in the Fitness Center. All beverages must be in capped, plastic or aluminum bottles – no glass allowed. • Please use the mailbox provided for keys and for other small personal items. Lockers are available for storage of gym bags, etc., on a daily basis in the men’s and women's locker rooms. Those who use this facility are deemed to have accepted these guidelines.

It is important to note that there are two separate web pages that you will access as a resident of Waterlefe: - Home Page: This is our public landing page with links to all Waterlefe amenities, including the Golf and River Club. - Member Central: This is our Members’ private homepage. Here you will find helpful information and links/forms for all your needs as a homeowner and member of our Master Property Owners’ Association (MPOA) Here is a step-by-step registration procedure to get your account set-up for the Waterlefe Members website: 1. Member Registration a. Click on the ‘Member Registration’ link to complete the Registration form. 2. Validation a. Enter your name and member number exactly as they appear on your Waterlefe member card in order to be verified as a Waterlefe resident. 3. Set Up Username / Password a. You will be asked to create a username and password that will be your login to waterlefemembers.com from here on out. Please make sure this is something that is easy to remember but unique to you. Once completed, click “Create User” to finish the registration process. 4. Email Confirmation a. After the user login has been created you should receive an email with all your information confirming your new account.
