A hamburger chain with multiple locations in Texas andCalifornia is planning to build more than 50 new outlets inboth the East and West this year.Based in Plano, Texas, Mooyah Burgers, Fries & Shakes saysit wants to put up at least 15, and perhaps as many as 20shops in metro Phoenix alone.The build-out plan for Phoenix may take up to a decade tocomplete, with an initial 3 or 4 possibly starting up later thisyear.The company, which has around one hundred locationsnationwide, also announced plans late last year to build up to30 new outlets in Florida.Founded in 2007, the Mooyah chain’s stock in trade is aburger made of fresh, never-frozen certified Angus Beef.Customers are also offered the choice of a wide variety ofvegetables for those burgers as well as the company’s ownMooyah Sauce.The company’s outlets vary in size between 2,400 and 3,000square feet, although a location opened last year in Orlandomeasuring 4,100 square feet. Talks and plans are underway for the construction of a newpublic recreation center in Silver City that may go up on thecampus of Western New Mexico University.Long anticipated, the facility would be designed to replacethe city’s current all-purpose recreation center, located at1016 N. Silver Street.At least $8 million is currently available for the project, withhalf of that amount coming from the State of New Mexicoand the rest from town funds.As discussed, the new facility would most likely housemultiple courts that could be used for indoor soccer,volleyball, and pickleball.A survey recently undertaken by the town indicated thatrespondents most want to see a swimming pool as part of thecenter, along with such amenities as a weight room andindoor track.Exactly how much a recreation center, with a pool, willultimately cost, remains to be seen. It’s one of the most fulfilling calls a broker can get. A longtime clientcontacts you to start a new site selection assignment. A high profilemulti-state search is the quintessential red-carpet event of theindustry. Job announcements, ribbon cuttings, and the boundlesssense of optimism that a new project delivers to the winningcommunity. Economic development officials from a place you didn’teven know existed will be courting your project. Inevitably,incentives will be part of the conversation and an over-the-topincentive offer can be rather enticing when your client makes its finaldecision.Numbers don’t lie and the financial impact of incentives is rathersimple to plug into your final analysis. Once your client signs thecontract, the long-term public relations can be an entirely differentmatter. When local or state governments are involved with providingincentives, the pride and joy of a ribbon cutting can vanish at the firstsign of trouble. Growing a new workforce is difficult enough withouthaving to fight local media and 50% of the state residents that mayoppose the governing party that provided your client the package.We here in Wisconsin have been at the epicenter of one of the mostcontroversial incentives awards in recent memory. The state ofWisconsin became the proverbial dog that caught the car when itprevailed in the 2017 Foxconn sweepstakes. The 8th Wonder of theWorld was going to encompass 20 million square feet of high-techmanufacturing, $10 billion in private investment and 13,000 jobs. TheFoxconn project was the envy of the Midwest and aggressivelypursued by several states. Wisconsin went all-in with a $4 billiondollar incentive package and we won the deal.Fast forward to 2021, while Foxconn has delivered four buildingstotaling over 1.5 million square feet, they have fallen woefully shortof projected hiring goals and an opaque cloud hangs over the futureof the development. The Wisconsin Economic DevelopmentCorporation (WEDC) recently notified Foxconn that they are ineligiblefor its annual tax incentive award for missing the minimum jobcreation targets. Good afternoon AGC NM Members & Industry Leaders,Late last week, the New Mexico Legislature concluded a 2-day specialsession to address Adult Cannabis Use and LEDA Changes. Both initiativeswere introduced during the Regular Legislative Session but were unable toget across the finish line before adjournment. House Bill 2 (Cannabis Regulation Act), sponsored by RepresentativeJavier Martinez and Representative Andrea Romero, decriminalizes thepossession, use, production, transportation, and sale of commercialcannabis for nonmedical adult use and creates a regulatory and taxationstructure. From an employer perspective, Section 34 (Employer Protections—Exemption) states that “unless there is an agreement between theemployer and the employee, nothing in the Cannabis Regulation Act shall: (1) restrict an employer's ability to prohibit or take adverse employmentaction against an employee for impairment by or possession or use ofintoxicating substances at work or during work hours; (2) require an employer to commit any act that would cause the employerto be noncompliant with or in violation of federal law or federal regulationsor that would result in the loss of a federal contract or federal funding; or (3) prevent or infringe upon the rights of an employer to adopt andimplement a written zero-tolerance policy regarding the use of cannabisproducts. A zero-tolerance policy may permit the discipline or terminationof an employee based on a positive drug test that indicates any amount ofdelta-9-tetrahydrocannabinol or delta-9-tetrahydrocannabinolmetabolite.”House Bill 2 passed the House of Representatives (38-32) and the Senate(22-15). The bill is now awaiting action from the Governor. The bill allows 50 percent of some state and localgross receipts tax (GRT) and compensating revenue from large LEDAprojects (over $350 million in construction and infrastructure costs) to beplaced into the LEDA fund to help with the recruitment of those largeprojects. Only costs associated with new construction of the project will besubject to this provision, and EDD and all local governments affected mustagree to the revenue sharing. The Economic Development Departmentstates that this new provision “allows the state to compete for projectsthat are so large that EDD may not have enough uncommitted LEDA fundsto successfully compete with offers from other states.”Senate Bill 1 passed the Senate (28-10) and the House of Representatives(59-8).
