BAR-o-METER | SEPT 20233From the PresidentAs I type this President’s column, I’ve just adjourned a lunch meeting with fellow ManagingPartners from several area law firms. The Managing Partners group is an informal committee ofthe WBA that has convened on an ad hoc or intermittent basis for at least the past decade, if notlonger. In its current iteration, the meeting serves as a tool for our organization to update firmleadership on the status and happenings of the WBA, and to collaborate on ideas and strategiesto better serve our members.*One strong, reoccurring theme that came from this meeting was this: a membership benefit thatfirms in particular often value most from the WBA is networking, collegiality, and, simply andsuccinctly put, fun. Last month I wrote about “preserving the collegiality” of the local bar and theWBA’s role in creating and maintaining that collegiality. I wrote that we have historically been “anactive professional and social organization that promoted relationships and professionalism. Theact of seeing one another at WBA events elevated these attributes.” It seems that others too seea risk that these relationships could be a thing of the past, if we don’t act now. The ideas on howwe do so are simple: let’s be together and have fun. Well, the WBA is ready to act (pun intended)! And we are ready to have fun! This month, the WBAwill once again be presenting the Bar Show, which returns for the first time since 2016. The BarShow is inarguably a premier event for our organization. For those who may not haveexperienced it before, think musical sketch comedy. Our highly talented members will take thestage to cap off our 2023 Judge’s Day activities on September 21 at the Crown Uptown Theater.For a mere $35 per ticket, you can enjoy dinner (thanks to our sponsor, Security 1st Title), drinksand a show. From a value proposition alone, this is a no-brainer! Lest we think that this invitation is a self-serving way to lobby an audience for my ownperformance, with all humility I have absolutely no music and dance talent whatsoever. I’ve neverparticipated in a bar show. But in my twenty years of practice, I’ve never missed a bar show tomy knowledge either. This includes those shows put on by the Topeka and Johnson County BarAssociations as well. Without any discredit to any of these other organizations, the Wichita BarShow is an outstanding production. It is, without question, fun to watch. And this event will be,without question, a fun social opportunity to eat, drink and laugh with our colleagues. Please accept the invitation. At KLS, I was fortunate to have a great deal of variety in my practice area. When I worked in the Topeka office, myprimary casework was devoted to housing, collections, and elder law. In the Wichita office, I worked on Afghan Asylum cases,managed the Dodge City KLS office, and oversaw a statewide program devoted to addressing housing and income concerns forpopulations with substance use disorders and mental health diagnoses. What made you want to be a judge?More so than being a judge, I wanted to do the work specific to the magistrate position in Sedgwick County. In my experience,these cases are the most common ways that people access the justice system, and I was interested in taking on a different role inthat important process. What qualities make for a good judge?Obviously, knowledge of the law, integrity, honesty, ability to be impartial, and a good temperament are the essentials. I thinksome of the best judges seem to have a sense of the responsibility that goes along with playing a big role in what is so often areally bad day in the lives of those appearing in front of them. Personal information/hobbies/fun fact:I have two English Mastiffs (Norman and Harry), I love going to Wichita Thunder games, and I took up playing the cellorecently. Appointment List AnnouncementPrivate attorneys representing indigent defendants are critical to the continuing administration of justice. During thepandemic, everyone’s resources were strained, including the court’s. As the pandemic subsided, the court system inSedgwick County has mostly recuperated. We are pretty close to returning to our pre-pandemic levels in terms ofboth volume of pending cases as well as processing times. But we still face problems.When an indigent defendant is charged with a crime, the Public Defender’s office is the first stop for representation.If that office has a conflict, our Conflicts Office (which is a branch of the Public Defender) takes the case. If that officealso has a conflict, the case is assigned to a rotating Appointment List. It is the Appointment List that has seen asubstantial reduction.For an attorney, taking court appointed cases can be very rewarding. We judges frequently hear that new attorneyshave a hard time getting valuable court experience. Taking court appointed cases provides opportunities for newattorneys to get into court and get necessary hearing and trial experience. For a new attorney at an established firm,taking these cases can provide some revenue opportunities for the firm when otherwise that new attorney's timecould not be billed to the client. Our opportunities include both trial work and appellate work. It is also a valuableway to provide one's service to the community.The number of attorneys on the Appointment List is still critically low. We have been able to find some Band-Aidsolutions, but without further help, these solutions are not sustainable. We have spent significant time reflecting onthe core issues that contributed to this problem, and in an effort to solve it, have identified some beginningsolutions.To help solve these problems, we urge our valuable colleagues in the bar to consider contributing as follows.PROBLEM: COURTS NOT USER FRIENDLYOur feedback from attorneys who used to be on the appointment list that have now withdrawn is that we were notuser friendly during the pandemic. When the Public Defenders and Conflicts offices would shut down due to highvolume, our appointment attorneys became inundated with a caseload that was too severe, too voluminous, orboth. My pledge to interested attorneys is that we will reconcile that problem. If you agree to be on the Appointment List,you can dictate the number, type, and severity level of case that you are willing to take. If those limits are exceeded,you may communicate directly with me, and I will fix the problem. It is important that people who take on thisimportant work can control their own parameters, and that they have a one-stop contact with authority to reconcilethe problem quickly and effectively.PROBLEM: WILLING ATTORNEYS NOT QUALIFIED TO TAKE CERTAIN CASESMany attorneys in our district would be willing to take more severe cases on the appointment list, but do not havethe required experience to take those. These same attorneys never have the opportunity to get qualified becausedoing so would require them trying cases for free. To solve that problem, we are excited to announce the creation ofthe second chair appointment program. The second chair program will allow attorneys to receive some compensation while becoming qualified. Thoseattorneys can work as a second chair on a trial case and be paid the BIDS (Board of Indigent Defense Services)reimbursement rate for their work. There is no restriction on firms, so an attorney can work with another attorney ina completely different firm as second chair as long as all conflict issues are resolved.We have already heard from a number of excellent attorneys who would provide that mentoring opportunity. This program may expire at the end of 2024, so please keep that in mind when you are calendaring cases to secondchair. We hope that these opportunities convince our colleagues to consider the Appointment List. We have a wonderfullocal bar, and we hope to see some new faces practicing in criminal court.Tyler J. It was a year of big changes for Lawyer League Softball. After playing at the “fields” at Coleman Middle School for thelast 40-ish years, the Commissioner had the brilliant and revolutionary idea to move the games to the West SideAthletic Fields (also known as the Kansas Sports Hall of Fame) at 571 N. McLean. It took a few weeks for the warmand fuzzy nostalgic feelings of Coleman to wear off. But once they did, I believe the consensus was that playing onthe West Side Athletic Fields produced a much more enjoyable and probably exponentially safer softball product.Thankfully, although we moved to a different location, we had our same faithful photographers for most of thegames this year. Linda and Mel Gregory continue to digitally capture the essence of Lawyer League Softball (i.e.many, many action shots of out of shape lawyers). Softball wouldn’t be the same without these two. In other news,the league was happy to welcome the good folks from Koch legal back into the league after a two-year absence. And now to the stats. After a hard-fought seven game regular season (with no rain games), the standings were asfollows:Regular Season Standings Wins Losses1. Force Majeure 2. Hinkle 3. Koch4. Martin Pringle 5. DeVaughn James 6. Biggs Paul 7. Morris Laing 8. Foulston 9. DA'sAnd now for the playoffs. QuarterfinalsIn order to determine who would obtain the coveted 8th seed for the playoffs, it was resolved that Foulston and theDA’s would play a 5-inning “play in” game, and the winner would immediately face the No. 1 Seed. After a hardfought battle, the DA’s erased a 7-1 deficit to win the game 8-7. Thereafter, the DA’s gave Force Majeure a goodscare, but Force Majeure was able to eke out a 7-5 win. The trend for close games did not end there. The remaining3 games were decided by a total of 7 runs. Hinkle beat Morris Laing 12 to 11; Biggs Paul narrowly escaped Koch, 5-4;and Devaughn James beat Martin Pringle 10-5. SemifinalsWhile the quarterfinals produced 4 close games, the semifinals were not so close. Force Majeure took downDevaughn James 24-1. And, Biggs Paul defeated Hinkle 24-6. Championship GameAs fate would have it, the two foes from last year’s Championship Game would meet again in the finals this year. Thegame lived up to its billing, albeit not in terms of exciting offense. It was a back-and-forth affair for the first couple ofinnings. However, by the 5th inning, Biggs Paul had built a 7-5 lead that they carried into the bottom of the 7th. Itwas at that time that Force Majeure found just enough offensive life. With one out and a runner on first, ForceMajeure was able to hit two doubles and a single to score 3 runs for the walk-off win. The crowd of 7 people wentwild. Hinkle was able to capture third after a Devaughn James forfeit. Another successful summer in the books. New fields, same teams, same sense of shared camaraderie, sporadicathletic talent, and occasional petty bickering between teams. But, these things together are what makes LawyerLeague Softball a great tradition for the Wichita legal community. 1. What is Go Red for Women?Go Red for Women is a women-focused initiative of the American Heart Association.Go Red for Women raises awareness of the issue of heart disease in women, andencourages action to save lives. The movement harnesses the energy, passion andpower women have to band together and collectively wipe out heart disease. Itchallenges them to know their risk for heart disease and act to reduce their personalrisk. It also gives them the tools they need to lead a heart-healthy life.Cardiovascular disease is the number one killer of women, eventually taking the livesof more women than all cancers combined. It is the number one killer of new moms,accounting for over 1/3 of all maternal deaths. More research and education areneeded.2. What is your role in the organization?I have the pleasure of serving as the current Chair for Go Red for Women Wichita.3. Why and how did you get involved with Go Red for Women?As an Alpha Phi in college, our philanthropy was the American Heart Association. GoRed for Women began years later, and Alpha Phi hosted a Red Dress Gala every yearas a fundraiser. I attend Alpha Phi Red Dress galas as an alumnus. Most recently, theAmerican Heart Association asked me to serve as the Chair of this year’s campaign. Iwas excited to be a part of their mission to spread awareness regarding women’sheart health, especially maternal health. The statistics for heart disease and womenare staggering. With my practice area of adoption, I felt a need to increase awarenessregarding maternal heart health and was able to focus this year’s GRFW platform onmaternal heart health and maternal health inequities.4. How can other lawyers help?You can learn more at the American Heart Association website, the Go Red forWomen website, or any social media platforms for the organization. The localAmerican Heart Association will also come to your office for training sessions. Theycame out to Martin Pringle for a Hands-only CPR training. 5. Where can people go to learn more?Money is always a way to help. Go Red for Women of Wichita has a fundraising eventon September 28, 2023, at the Vail. We will be honoring several Wichita survivors andsharing their stories. There will be an auction as well.
