FROM THE PRESIDENT C Edward Watson II May 1st is Law Day Our bar celebration is on May 11th at the Botanica Gardens I hope you all show up The 2021 Law Day theme is Advancing the Rule of Law The concept is to bring urgency to the practical application of the ideas embedded in the United States Constitution We all share the responsibility particularly as attorneys to promote the rule of law defend liberty and pursue justice In my mind the theme means we cannot just talk the talk It s not how loud we can be or how prolific we can be on social media We must walk the walk Law Day is another opportunity to show Kansas pride In 1958 President Dwight D Eisenhower a Kansan by choice declared May 1st as Law Day to promote the rule of law Having seen the worst of mankind fighting the Nazis in Europe seeing concentration camps and all the other related horrors Eisenhower committed to using the power of his presidency to ensure that our way of life and the promises of a free and fair society were guaranteed to Americans There is a lot to celebrate about Eisenhower s life He was the Supreme Commander of the Allied Forces during World War II responsible for planning and supervising the invasion of North Africa and the invasion of Normandy In a very real sense he led the efforts to save democracy for us all But what is not often recognized is Eisenhower s contribution to the preservation of democracy that extended past his wartime feats He personified the belief in the importance of justice and the rule of law by the actions he took while he served as president His use of constitutional authority as the chief executive demonstrated that he embraced the idea that justice should be available for all BAR O METER LITE MAY 2021 Dealing with the questions surrounding the rule of law in the 1950s necessarily meant that he would have to grapple with the unfair treatment of people of color in our nation If we can accept that our nation is a work in progress moving toward a more perfect union then we can understand how important his presidency was toward moving our nation forward on the question of civil rights for all Eisenhower could have easily rope a dopped many of the difficult civil rights challenges of his presidency 19521960 and still won reelection by a landslide But he chose to tackle these difficult issues head on He walked the walk In his book A Matter of Justice Eisenhower and the Beginning of the Civil Rights Revolution Dr David A Nichols argues that Eisenhower worked to desegregate Washington D C and complete the desegregation of the U S armed forces One can debate how successful these efforts were as I have second hand knowledge don t start making hearsay objections that the D C schools at least remained segregated for years following Eisenhower s presidency But it s pretty clear that Eisenhower s presidency improved life for people of color in Washington D C at least incrementally Other evidence of Eisenhower s commitment to the rule of law includes his decision following Brown v Topeka Board of Education a ruling he personally opposed to send federal troops to Little Rock s Central High School to enforce a federal court s order mandating integration To make use of the military to ensure that a everyone honored and adhered to rulings of the courts and b disenfranchised African Americans would have access to basic education PAGE 2

FROM THE PRESIDENT CONTINUED without harassment was a relatively bold step demonstrating Eisenhower s willingness to use executive power to bring about equality for people of color when Congress was not yet prepared to make that commitment Eisenhower also signed the Civil Rights Act of 1957 into law While this legislation was stripped of its teeth before passage ironically by LBJ and thus not particularly effective it laid the foundation for the more robust and effective Civil Rights Act of 1965 signed by LBJ Some would argue that had it not been for Eisenhower s efforts in the 1950s the 1965 Civil Rights Act would not have become a reality One of Eisenhower s most significant contributions to the rule of law and the extension of civil rights to African Americans is his refusal as a matter of policy to appoint segregationist judges on the federal bench Many of the key decisions that advanced civil rights were made by Eisenhower appointed judges I am not here to suggest that Eisenhower was an unrecognized civil rights saint By today s standards and certainly from my lens as an African American man Eisenhower said some PAGE 3 fairly ugly things at least as reported by Justice Earl Warren again hearsay that would have likely kept me and my parents at the back of the bus for decades While a product of his times Eisenhauer valued freedom and our system of justice He did what he could for whatever reasons to advance the notion that we are governed by laws and that our systems of justice ought to be fair regardless of race color or creed What does this mean for us While only a few of us may be President of the United States one day all of us no matter our political persuasions have an opportunity to walk the walk in our respective spheres of influence to ensure that freedom and justice are available for everyone We may not agree on the how to bring freedom to everyone But we should all agree that the courts and the ballot box should be available to all Americans no matter race color or creed And as attorneys we can use our positions to ensure that justice is available for all So join me on May 11th as we celebrate our uniquely American democratic experiment built upon the rule of law BAR O METER LITE MAY 2021

ichita Bar Association 2021 Award Recipients The Liberty Bell Award is given by the Young Lawyers Section in recognition of an individual s or organization s outstanding community service and dedication to the rule of law Benson Batt Award is given by the Law in Education Committee in the names of Judge Fred Benson and Beverly Batt to honor their years of organizing lawrelated events for local students Chief Darrell Haynes started his law enforcement career at age 18 buying drugs for the Sedgwick County Sheriff s Office in 1973 He also served as a Court Guard before being hired by the Wichita Police Department in 1976 At the WPD he served as a Police Officer a Vice and Organized Crime Intelligence Detective Booking Patrol and Detective Lieutenant and as a Watch Commander He was promoted to Captain in May of 1998 and served as the Captain of Patrol South Administrative Services Professional Standards Special Operations and finished his WPD career with four years as the Property Crimes Investigations Commander Honorable Ted Griffith posthumously was sworn in as a Municipal Judge for the City of Wichita in 2009 He typically presided over traffic and DUI cases where he was known for being especially thorough and detailed in his explanations from the bench Prior to attending law school Judge Griffith served as a police officer in Baxter Springs for 12 years He graduated from the Washburn University School of Law in 2001 Upon graduation Judge Griffith worked as an Assistant City Prosecuting Attorney for the City of Wichita a job he would hold until he became Judge Since the WPD he has been the Security Director for a regional bank and for the last eight years has been the Chief of the Sedgwick County Courthouse Police Department Chief Haynes has an Associate and Bachelor s Degree in Administration of Justice from Wichita State University with post graduate work at the University of Virginia in conjunction with his attendance at the FBI National Academy In 2018 Judge Griffith was appointed by the Supreme Court of Kansas to the Municipal Court Judges Education Committee While serving on this committee Judge Griffith was involved not only in educating law trained judges but he was also instrumental in the development of educational materials for all the non law trained municipal judges throughout the state Judge Griffith regularly sat on panels and made presentations due to his expertise on traffic and DUI matters As Lance Gillett stated Judge Griffith was a consummate teacher He was always willing to listen take from his own time to lend a hand and he readily shared lessons from his experience with anyone who needed it Many other attorneys were fortunate enough to have similar experiences with Judge Griffith Judge Griffith passed away on February 8 2021 He is deeply missed within the Wichita Municipal Court and by members of the Wichita Bar BAR O METER LITE MAY 2021 PAGE 6

ichita Bar Association 2021 Award Recipients The Jonalou Pinnell Distinguished Service Award is given for outstanding volunteer services to the Wichita Bar Association by a non lawyer The award recognizes longstanding service or the accomplishment of a single task or service in any given year The Wichita Bar Auxiliary was founded in 1935 with membership open to spouses and surviving spouses of Wichita area attorneys and judges The Auxiliary s purpose was to extend the aims and purposes of the WBA and legal profession to the public to promote goodwill among members and the WBA to encourage participation in law related activities and to perform law related philanthropic educational and community service work In more recent years with more spouses with their own careers with more activities for their children requiring parental participation and less free time during the day or evenings interest in holding office and attending activities has dwindled The officers of 2019 2020 proposed folding the organization unless members were interested in continuing The consensus was the time for a person to belong to a spouse oriented organization has ended and with that the Wichita Bar Association Auxiliary has ended The Wichita Bar Association appreciates the contributions and assistance that the Auxiliary has provided over the years If anyone is missing the AUX and is willing to step forward and start the organization up again please contact Virdena Gilkey at the Wichita Bar Association The President s Award is given in recognition of outstanding service in the current year or within the past few years It recognizes the successful accomplishment of a law related project or service where the recipient s work substantially exceeds that which is normally expected The recipient also must demonstrate high ethical standards and hold the respect of his her peers PAGE 7 Karl Hesse is a partner at Foulston Siefkin LLP and concentrates his practice in energy and real estate His experience in the energy industry began at Koch Industries where he ultimately became General Counsel for Koch oil Company Refining Company after developing skills in both the trial and business legal teams Karl assists landowners and mineral owners with negotiating oil and gas leases oil and gas producers with title examination and other everyday business issues and represents midstream clients in transactions involving the transportation and exchange of petroleum products Karl has a broad real estate practice as well from straightforward property transfer lease or transaction to complex commercial development and wind energy projects Additionally he has represented clients in exemption and valuation tax appeals before the Kansas Court of Tax Appeals Licensed in Kansas Colorado and North Dakota Karl has earned Martindale Hubbell Law Directory s AV rating for lawyers Karl graduated from Washburn University School of Law in 1992 where he served as Comments Editor for the Washburn Law Journal His involvement in the Wichita community has focused on agencies helping children He has served on the boards of directors for A Better Choice Crisis Pregnancy Center Girl Scouts of the Heartland CASA of Sedgwick County where he also served as board president and currently he is on the board of The Pando Initiative where he also serves as a member of its governance committee When not at work Karl enjoys running sampling craft beers hiking in the Rocky Mountains and spending time with his family wife Pam a real estate agent with Weigand sons Cole Ashley and Max and daughter Jean He s looking forward to his stint as a grandfather when Pierce Roy comes on the scene this July BAR O METER LITE MAY 2021

ichita Bar Association 2021 Award Recipients Jennifer Magana graduated from the University of Kansas School of Law after receiving a Bachelor of Arts in Journalism and Mass Communications from Kansas State University From 1993 1996 she was a City Prosecutor for the City of Wichita where she prosecuted criminal cases in Municipal Court including traffic DUI domestic violence and environmental issues She then served in the Sedgwick County Counselor s office for 19 years as an Assistant County Counselor and Deputy County Counselor advising and representing the Board of Sedgwick County Commissioners and other elected County officials In 2015 she became the City Attorney and Director of Law for the City of Wichita As a WBA member since 1993 Jennifer has served as Secretary a member of the Board of Governors Chair of the Public Relations and Law in Education Committees and as a member of the Bar o Meter staff for 25 years from back when articles were submitted on paper She has been a speaker for Law Day and Constitution Day and was once a member of Young Lawyers As a member of the Wichita Women Attorneys Association Jennifer held various offices and is a Louise Maddox Award recipient She is currently a member of the Newman University Board of Trustees and the advisory board of Women in Public Service and has previously served on the Board of Directors for Wichita Festivals Inc CASA of Sedgwick County and Kansas School for Effective Learning KANSEL and as President and a board member of the County Counselors Association of Kansas Jennifer was a Wichita Business Journal 40 Under 40 honoree and received the DeVore Foundation Excellence in Public Service Award and the Ed Randels Award from the County Counselors Association of Kansas She is married to Judge Christopher Magana and they have two daughters Ty Patton was born in Topeka and raised in Benton Kansas He earned his Bachelor of Science in History cum laude from Emporia State University in May 2009 and obtained his Juris Doctorate cum laude from Washburn University School of Law in December 2011 He is also a graduate of the World Wide College of Auctioneering and the Professional Ringmen s Institute Ty has worked as general counsel auctioneer and a realtor with McCurdy Auction LLC since 2015 Previously Ty practiced law at Riordon Fincher Beckerman in Topeka Kansas where he focused on the areas of creditor rights asset protection real estate litigation transactional drafting and estate planning and probate He is currently co chair of the Wichita Bar Association Estate Planning and Probate Committee and a member of the Kansas and Wichita Bar Associations the Kansas and National Auctioneers BAR O METER LITE MAY 2021 PAGE 8

ichita Bar Association 2021 Award Recipients Association and the National Association of REALTORS Kansas Association of REALTORS REALTORS of South Central Kansas and REALTORS Land Institute Ty has recently presented or taught at the annual WBA Real Estate and Business Law CLE annual WBA Estate Planning and Probate CLE as well as at the 3i Farm Show and Great Bend Farm Ranch Hemp Expo on the topics of agricultural leases and other legal considerations He is a past chair of the Board of Directors for Wichita Festivals Inc current President of Old Wichita Cowtown Museum Inc a co founder and member of the leadership team for Connecting ICT and serves on the Wichita Regional Chamber of Commerce Small Business Awards committee Ty is also currently a candidate for Man of the Year for the Leukemia Lymphoma Society Justin Waggoner a 2008 graduate from the University of Kansas School of Law has served as an Assistant County Counselor for Sedgwick County since 2013 His principal work includes advising the Board of County Commissioners and other Sedgwick County staff on planning and zoning additional property related matters public health and other health and human services matters Justin serves as the Vice President of the County Counselors Association of Kansas and is the Chair of the WBA Law in Education Committee from Washburn University a Bachelor of Arts degree in Criminal Justice received in 1989 and a law degree received in 1992 Following law school Judge Birzer practiced law in Topeka Kansas in the public sector as an assistant public defender an assistant district attorney and as an assistant attorney general and in the private sector in her own firm In 2004 Judge Birzer relocated to Wichita Kansas where she worked at the Sedgwick County Public Defender s Office In 2006 she joined Hite Fanning Honeyman L L P where she specialized in medical malpractice defense litigation Judge Birzer has served on the Board of Governors on both the Kansas Bar Association and the Wichita Bar Association and she has served those organizations on various committees In 2011 Judge Birzer became a partner in the firm and she served in that capacity until her judicial appointment In addition to her judicial responsibilities Judge Birzer serves her community on various boards and civic organizations including Board of Directors for Dear Neighbor Ministries Stepstone Music Theater of Wichita and the Arts Council of Wichita Judge Birzer has been an avid champion of diversity and inclusion initiatives and public service organizations particularly her sorority Delta Sigma Theta Sorority Incorporated She is also a Kansas Fellow of the American Bar Association Judge Birzer and her husband Michael have a 15 year old son Chester I Lewis Diversity Achievement Award is given in recognition of an individual law firm or organization s significant contributions to the advancement of diversity in the legal profession The Honorable Gwynne E Birzer the sixth United States Magistrate Judge sitting in Wichita Kansas was appointed to the bench on July 1 2015 Judge Birzer holds an Associates Degree from Kansas City Kansas Community College two degrees PAGE 9 BAR O METER LITE MAY 2021

ichitaBar BarAssociation Association2021 2021 ichita AwardRecipients Recipients Award The Howard C Kline Distinguished Service Award recognizes members who through the years of their practice have exemplified integrity professionalism and service to the bar The recipient is one whose qualifications and accomplishments are undeniably exemplary and who is widely acclaimed as having made significant contributions to the honor and practice of law The award recognizes long standing service rather than the accomplishment of a single task In 1999 Judge Jones was selected by the Supreme Court to serve as a member of the Commission on Judicial Qualifications She served as Chair of the Commission in 2006 and 2007 before ending her tenure in 2012 Honorable Jennifer Jones is a native of Wichita Kansas She obtained her Juris Doctorate Degree from the University of Oklahoma in 1985 In addition to meeting the demands of Kansas largest court Judge Jones still finds time to give back to the community She serves as an officer in the Wichita Chapter of The Links Inc and as Chair of the Trustees at Tabernacle Bible Church She maintains memberships in the Kansas and Wichita Bar Associations After graduating from law school Judge Jones began her career in the office of the District Attorney in Muskogee Oklahoma While in this position she actively prosecuted all types of cases and later developed a specialty in prosecuting sex offenses child abuse and juvenile cases In May 1988 she returned to Wichita and became associated with the law firm of Bruce and Davis becoming a partner in January 1992 She maintained an active general practice in the areas of commercial juvenile family bankruptcy and probate law In January 2001 Judge Jones began her current position in the Municipal Court for the City of Wichita Kansas and was selected to serve as the Chief Judge in 2003 Judge Jones has made numerous contributions to the Wichita Bar Association Impaired Lawyers Committee CLE presenter Law Day speaker new attorney orientation Grow Your Own Lawyer mentor Municipal Practice Committee Diversity Committee and the Juvenile Practice Committee Judge Jones is a wife and mother of two sons who enjoys sports traveling shopping and spending time with her extended family In 1992 she successfully ran for the position of Sedgwick County District Court Judge becoming the first African American woman judge in Kansas Click here to register for the Law Day and Awards Luncheon BAR O METER LITE MAY 2021 PAGE 10

ichita Bar Association 2021 Award Recipients The Lifetime Achievement Award is given for sustained superior performance that recognizably sets the recipient apart from peers The recipient is one whose accomplishments have brought credit and recognition to the profession and who has demonstrated exemplary ethical standards and high personal values Jackie Williams years as a public servant began after graduating from Wichita State University and Washburn Law School Jackie has served as an Assistant Attorney General for the State of Kansas worked in the Sedgwick County DA s Office where he led the Consumer Fraud and Economic Crime Division and eventually was named the U S Attorney for the State of Kansas In that role Jackie oversaw 36 federal prosecutors and 47 support staff After serving with distinction for 23 years he retired from that role in 2001 The prosecutor then became Professor as he returned to his beloved alma mater WSU as the Distinguished Senior Fellow in the School of Community Affairs Jackie served his university with his trademark commitment and in 2016 was honored with the WSU Alumni Recognition Award The love of law lured him back to the courtroom and in 2008 he was appointed the City Attorney for Topeka Attorney General Derek Schmidt called him back to service at the state level in 2011 where he serves today as Deputy Attorney General Director of the Medicaid Fraud Abuse Division PAGE 11 BAR O METER LITE MAY 2021

District Court Judge Quentin Pittman By David N Johnson Did you know one of our Sedgwick County District Court Judges is also an author who writes under a pen name His pen name is a secret that his Honor declined to disclose even to one of his brethren on the bench After engaging in a busy private practice over the past 10 years and previously working in the public defender s office Quentin Pittman was elected this past November as a Sedgwick County District Court Judge Division 7 Judge Pittman has been serving in the Family Law Department since January 2021 hearing divorce paternity child custody support property division and other domestic cases Judge Pittman was born in Cincinnati Ohio in 1970 He attended school in Zionsville Indiana where his father still resides His interest in practicing law percolated while he was earning his undergraduate degree in journalism from Truman State University in Kirksville Missouri Judge Pittman clerked for a law firm which included even writing briefs He also worked for the county attorney s office doing pretty much whatever needed to be done After graduating from college in 1998 Judge Pittman continued to work his way west by moving to Kansas to attend Washburn Law School He graduated in 2001 and worked for the Stockton law firm in Johnson County Kansas while his soon to be wife Stephanie was completing her third year of law school They married and moved to Wichita where Stephanie has a family Judge Pittman and Stephanie opened a law practice in Wichita across the hall from Paul Dugan s office After a year or so Stephanie took a position with the Public Defender s office where he joined her shortly thereafter Stephanie worked at the Public Defender s office for three 3 years and Judge was there for six 6 years before opening a practice with Casey Cotton in 2010 Judge Pittman handled civil defense and criminal cases across the State One of the factors that led to running for judge was a harried schedule of working from 8 00 a m to 8 00 p m Sundays through Fridays which left him little time other than Saturdays to spend with his wife and four children While he really likes the law Judge Pittman found running the business of operating a law practice not so rewarding Judge Pittman has enjoyed hearing family law cases which he has found to be a good challenge He takes the same BAR O METER LITE MAY 2021 approach on the bench with cases as he did in private practice by not taking anything for granted and reviewing the applicable statutes and case law to make sure nothing has changed Judge Pittman said he has also had the benefit of really good lawyers who have helped him and practiced before him He singled out Charlie Harris who retired four years ago but helps pro se litigants on Mondays with his advice and counsel on family law cases from time to time Noting the importance of surrounding yourself with good people Judge Pittman said I have the benefit of a great judicial aide Rita Parrott He also values his longtime friendships with two senior veterans of the Wichita Bar and Kansas politics albeit from opposing political parties Paul Dugan and Vern Miller As for the traits he strives to attain as a judge Judge Pittman said humility and the ability to make a decision are among those he considers to be most important I have my faults but having an ego is not one of them Judge Pittman said I m not afraid to admit when I m wrong Among the primary goals he wants to achieve in the Family Law Department is to get cases resolved and trials conducted when the parties do not settle Judge Pittman found he has had to put time limits on each side s presentation at trial He stressed that counsel should have a rationale for what they present either legal or fact based Touching on our tendency as attorneys to sometimes be verbose Judge Pittman said I m a lawyer You give me all afternoon I can probably fill it up Noting that he presides over a court of equity not sympathy Judge Pittman said All I m trying to do is apply the facts to the law He said his job is not to empathize with litigants before him but to treat parties fairly and impartially When he s not on the bench or preparing decisions Judge Pittman has been helping his older sons who are nearing driving age to restore their cars His favorite past time continues to be writing I don t have a lot of time but it s kind of what I like to do When one of his colleagues on the bench asked Judge Pittman what his pen name was Judge Pittman asked him Can you keep a secret His colleague assured him that he could Judge Pittman replied So can I PAGE 12
