REAL ESTATE TermsPRE-APPROVAL TITLE SEARCHA pre-qualification or pre-approval letter is adocument from a lender stating that thelender is tentatively willing to lend to you, upto a certain loan amount. This document isbased on certain assumptions and it is not aguaranteed loan offer.A title search is an examination of publicrecords to determine and confirm a property'slegal ownership, and find out what claims orliens are on the property usually performed bya title company or an attorney on behalf of aprospective buyer.OFFERAn offer is a conditional proposal made to theseller, and often list the highest price they arewilling to pay. Once this official offer issubmitted on a piece of real estate, it isconsidered binding if the seller accepts theoffer.CONTINGENCYA contingency clause is attached to an offer topurchase real estate and included in the realestate contract. Essentially, a contingencyclause gives parties the right to back out of thecontract under certain circumstances thatmust be negotiated between the buyer andseller.CLOSING COSTSClosing costs occur when the title of a propertyis transferred from the seller to a buyer. The home inspectorwill assess the physical structure of the home,from the foundation to the roof, as well as thehome's systems to determine if the home is upto code.DISCLOSURESIn general, a disclosure document is a writtendocument that provide details about aproperty’s condition that might negativelyaffect its value.EARNEST MONEYEarnest money is a deposit made to a sellerthat represents a buyer's good faith to buy ahome. MAKING AN OFFERTHE PRICEWhen you are in position to make an offeron a home there are some things to keep inmind. It is ideal to consider the conditionof the home, the length of days that it hasbeen listed on the market, any activity frombuyers, and the motivation or urgency ofthe sellers. Generally, there are buyers thatwant to submit "low" offers just to "seewhat happens", but this is not a choice thatI support for my buyers simply because itwill not put you in the best position fornegotiations. Often times, sellers view"low" offers as an insult and choose not toentertain the idea of the suggested salesprice.THE MOVE-IN DATEFlexibility on the move in datemakes your offer more appealingwhen sellers are decidingbetween multiple offers in somecases.ADDITIONAL PROPERTYAlthough it is common for a seller to leave behind major appliances such as refrigerators,microwaves, ovens, etc. Determining which items in particular remain as part of the sale,becomes a matter of negotiation. It is uncommon for you as the buyer to be present when your offer is presented to the seller.As your agent, I will present your offer to the listing agent and/or seller on your behalf.The seller will have the option to do one of the follow:Accept the offerReject the offerCounter the offer with changesThe most common response from the sellers is to counter the offer with changes. CLOSING 101OWNERSHIP Two events will take place to transfer ownership from the seller to you:Delivery of buyer's fundsDelivery of the deedThe deed is the document that transfers the ownership of real estate from the sellerto the buyer. This document will have named both parties involved in thetransaction (the seller and you as the buyer), the legal description of the property,and notarized signatures of the sellers along with witnesses.At the end of the closing process, the deed will be taken to the county clerk's office tobe recorded and mailed out to you after processing.During this part of the process your lender will have supplied a check or wiredfunds in the amount of the loan.Closing Day is the day that you haveachieved the goals of HomeOwnership!
