Liability (1) Les Jardins shall not be liable for any lost prots or savings, loss of reputation or goodwill, indirect or incidental or consequential damag-es arising out of or in connection with the sale of the goods by Les Jardins or the use of these goods whether or not any claim is based on tort, warranty, contract, or any legal possibility, even in the circum-stance that beforehand Les Jardins has been advised of the risks.(2) In the case that a defective product has been replaced by Les Jardins, Les Jardins cannot be held liable for circumstantial and/or additional costs to be made at the premises of the nal customer, such as (but not limited to) the (re)installation of the replaced products, change of technical installations and other.Intellectual Property (1) The Buyer acknowledges and agrees that all copyright, trademarks, and all other intellectual property rights in all the Les Jardins literature and websites shall remain at all times vested in Les Jardins. TEAK FURNITURE • 3 year warranty for residential applications • 3 year warranty for slings in residential settings ALUMINUM FURNITURE • 6 year warranty for residential applications • 3 year warranty for slings in residential settings WOVEN RESIN/ROPE FURNITURE • 3 year warranty for residential applications HPL/CERAMIC • 8 year warranty on ceramic tops • 3 year warranty on HPL tops SOLAR LIGHTING WARRANTY • Refer to above applicable warranties for frames • 1 year warranty for ASB (solar modules) Les Jardins Limited Warranty Les Jardins warrants the original commercial purchaser that its products shall be free from defects in materials and workmanship for: a period of three (3) years for Teak frames, six (6) years for aluminum frames, one (1) year for slings and cushions, and one (1) year for solar products from the date of original purchase by the commercial custom-er. If the product fails due to defects in material or workmanship during this warranty period, Les Jardins will repair or replace, at its option, the product part that is in question free of charge. The word “defects”, as used in this warranty, is dened as imperfections, which impair the utility of the product. The warranty is expressly limited to the replacement of furniture and/or furniture components. Les Jardins will either provide replacement furniture/parts or otherwise repair the furniture at no cost to the customer. In the event of piece replacement, no assembly labor is included. Should an item not be repaired to the customer’s satisfaction, a replacement part or piece will be furnished at Les Jardins’ expense. In the event that a customer alleges a defect, Les Jardins requires that a photo of the defect be sent to determine the nature and extent of the defect EXCLUSIONS This Limited Warranty does not apply to damage resulting from normal wear & tear, handling, improper or lack of use, care, or maintenance, abuse, accident, alteration, tampering, natural variation of color, texture, or grain and aging of natural products, or use in violation of applicable laws, rules, regulations, and ordinances. Customer’s Own Material (COM) and any other material are not covered by this warranty. Repair or modication by anyone other than Les Jardins or an ap-proved agent of Les Jardins voids the warranty. Additional exceptions may apply. Freight damage is not covered under our Les Jardins Limit-ed Residential Warranty. Les Jardins expressly disclaims all other warranties, express or im-plied, statutory or otherwise, including but not limited to, any warranty of merchantability, title, noninfringement, or tness for a particular purpose. We reserve the right to discontinue or modify any product line or color without notifying the Purchaser. If the original product is not available, we retain the right to choose to provide replacement material of equal value or quality. No person or entity is authorized by Les Jardins to make (and Les Jar-dins shall not be bound by) any statement or representation as to the quality or performance of Les Jardins products other than as contained in this warranty. This warranty may not be altered or amended except in a written instru-ment signed by Les Jardins and Purchaser. Under no circumstances will Les Jardins be liable for special, incidental or consequential dam-ages, whether such damages are sought in contract, in tort (including but not limited to negligence and strict liability) or otherwise, and Les Jardins’ liability with respect to defective products shall in no event ex-ceed the replacement of such products or return of the purchase price, as described above. WOOD FRAMES Wood frames are warranted to not break or crack for three (3) years of residential use. Wood frames require user maintenance and changes in the color of the wood are normal and should be expected to occur over time as the natural material ages. Therefore, fading and color chang-es in wood frames are not covered by this warranty. Small checks in the surface (minuscule openings of the wood grain at the ends when exposed to the elements over time) are natural and in no way affect the structural integrity of the frames. Supercial checks are not covered by this warranty. Components such as plastic foot glides are subject to wear and tear and are not considered part of the frame. METAL FRAMES Welds and joints are warranted to not break or crack for six (6) years of residential use. Powder coat nish is warranted to not peel for six (6) years of residential use. Rust or corrosion of metal components, when placed in close proximity to known salt environments, is not covered by this warranty. SLING FABRIC Sling fabric is warranted from tears and becoming non-functional because of loss of dimensional stability from exposure conditions in-cluding sunlight and normal atmospheric conditions for three (3) years of residential use. Abnormal or excessive discoloration and fading are covered. Ceramic/HPL Ceramic and HPL warranties cover abnormal or excessive discolor-ation and fading within the coverage periods. Ceramic eight (8) years and HPL three (3) years. Breakage and cracks are not covered by this warranty. SOLAR LIGHTING ASBs (Autonomous Solar Bulbs) are warranted from manufacturer de-fects for one (1) year. Replacements will be sent during this period for issues resulting in non-performance. This does not include issues aris-ing from droppage, lack of maintenance, or water damage. Peeling of the solar panel is cosmetic and not grounds for replacement. Customer must perform troubleshooting steps before a replacement is given. Proper maintenance of your product is required to support the benets of this warranty. This warranty is voided in the event that there are indications of abuse or neglect. This warranty does not apply to normal wear and tear effects on Les Jardins products, which are received by regular use of the products.TERMS & CONDITIONS 90 |
