Operation of motor vehicles is a necessary part of Hager Brothers Trucking, Inc. Theoperation of motor vehicles exposes our company to a variety of risks: injury to employees,injury to members of the general public, damaged property, and possible negative influencesto the company's reputation. Therefore, as part of management's commitment to operate allaspects of the business in a safe and responsible manner, the following policies should beendorsed.The Hager Brothers Trucking, Inc. program establishes guidelines and procedures to befollowed to protect the safety of individuals operating any motor vehicle on company business.Protecting our employee drivers, their passengers, and the general public is of the highestpriority to the company.The commitment of owners, management, and employees is critical to the success of thisprogram. Clear communication of and strict adherence to the program's guidelines andprocedures are essential.The purpose of this policy is to ensure the safety of the employees who drive or ride incompany vehicles. Vehicle accidents can result in employee injuries, damaged vehicles andproperty, and a variety of higher costs. It is the driver's responsibility to operate the vehicle in asafe and courteous manner, following all of the motor vehicle regulations that apply to thatvehicle. It is also the driver's responsibility to make sure that the vehicle is maintained in goodcondition by reporting any problems to the maintenance staff.POLICY STATEMENTJames HagerPresidentHager Brothers Trucking
Program Responsibilities: The fleet manager is responsible for the safe operation and enforcement of all drivingpolicies. The fleet manager and Owner will authorize employees to drive company vehicles. Hiring Polices: The minimum requirement for hiring the applicant will include the following: Applicant must have a valid Class A Commercial Drivers licenseComplete written application and turn in all necessary paperworkHave NO DUI or DWl convictions in the last 5 yearsMust be over the Age of 24, unless otherwise approvedA minimum of 3 years of experienceApplicants over the age of 65 must pass a DOT physical & Eye Exam & provide copies. Meet all requirements of Department of Transportation for those individuals beinghired to drive commercial motor vehiclesPer MVR and PSP, Must not have more than 2 Violations in the Last year, No more than4 In the total 3 year periodIf the 2 Violations calculate to over 6 in ordinance with our Points system, Employmentwill not be feasibleHave no positive Drug Results in the past 5 years including hits on Clearinghouse portal For more information please request copy of Insurance Company Hiring RequirementsFiles and Personal Information:All Files & applications are kept in ordinance with DOT regulations. All Drug and Alcohol testing is kept for a 5 year period.This includes Negative, Refused, Canceled, and Positive test. Driver Accident Review:When an accident occurs, management will look at fault, previous offenses, and overallwork of the employee to determine if termination or disciplinary action needs to be taken.Disciplinary action can lead to termination at the discrepancy of Management or if theDriver was already on a Probationary status. Additional Training will always take placeafter an accident.
Driver Safety Rules:Drivers are required to follow all posted and/or accepted rules concerning theoperation of a motor vehicle over both public and private roadways andproperty. Seat belt use - is mandated by law and Hager Brothers Trucking Inc.requires driver and passengers to wear seat belts while the vehicle is inoperation. Impaired driving - a driver may not operate a motor vehicle at any timewhen his/her ability is impaired, affected, or influenced by alcohol, illegaldrugs, medication that can affect cognitive ability, illness, fatigue or injury. Hitchhikers -DO NOT pick up hitchhikers at any time. Eating and drinking - eating while driving is prohibited. Non-alcoholicdrinking can be done while driving, but use caution. The number one goalis safe driving. Radar detectors - are prohibited from use in company vehicles. Companyvehicles should be operated within the posted speed limits. All rules of the road should be followed while operating a companyvehicle. Texting and Driving:Hager Brothers Construction, Inc. will not tolerate texting or talking on a hand-held phonewhile operating a commercial motor vehicle. This includes, but is not limited to, answeringor making phone calls, engaging in phone conversations, reading or responding to e-mails,text messages, and accessing the internet.. Drivers are strongly encouraged to install anduse handsfree systems. U-turns:U turns are prohibited by Hager Brothers Trucking, Unless directed by a law enforcementofficer to do so. Please find a safer alternative route when necessary.
Vehicle Use:It is the policy of this company that the commercial motor vehicles provided for some ofour employees are to be used only for company business. Any personal use of the company vehicles is to be made in writing, or noted phoneconversations with company executive officers, stating the nature of each personal use. A decision to allow limited personal use shall be based upon past driver performance andusage anticipated. The company may allow its employees to drive the company vehiclehome at night and on weekends for its convenience and/or security purposes. This mayalso be in case of client/project emergencies that these employees may be called upon tohandle. The use of company vehicles is restricted to employees of the company only. Non-employees such as spouses, children, other relatives, or friends are not authorized to drivecompany vehicles at any time. Hager Brothers Trucking, Inc. is not liable for accidents thatmay occur if drivers or Owner Operators choose to bring their families on board withthem.Pets/Animals are not allowed in the vehicle. Any accidents as a result will put the driver asliable. The company will consider any unauthorized use of vehicles, as the equivalent of theft andthe driver may be held responsible (liable) for consequences of any accidents. A driverroad observation program is also in effect to monitor usage of the vehicles during businessand off-hours. Employees driving company vehicles will be observed on a random basis,after call in complaints, and after an accident. If any negative results are found, a warningwill be issued to the employee. A second warning will be cause for termination ofemployment in accordance with company policyBy signing the Fleet Driver Commitment page at the end of this policy, you haveacknowleged and understood the paragraphs above.
Vehicle Maintenance:To extend the useful life of all vehicles, regular inspections and maintenance schedules willbe maintained. The assigned driver of each vehicle should ensure that all generalmaintenance is completed per manufacturer's recommendations. General maintenanceincludes oil changes, tire rotations, tire pressure checks, fluid level checks, washing andcleaning of the interior and exterior. The vehicle should be inspected daily for cleanliness,proper tire pressure, non-functioning lights, motor oil, coolant, windshield wiper fluid, andfuel. This should be logged on driver Daily vehicle inspection log. You will also have adetailed Pre-Trip Flyer that shows all the points that need to be hit during Pre-TripInspection. Drivers are required to turn in a Pre-Trip Or Post trip inspection everyday worked, thisis also possible to turn it virtually via our ELD system.If defects are found, Drivers are responsible to make sure it gets fixed and notify adispatcher. Owner Operators are responsible monetarily for any repairs as stated intheir lease agreement. Receipts are required if fixed outside Hager Brothers ShopA general Maintenance Log must be kept in the truck for the 12 months priorAnnual Inspections will be required on all Trucks and Trailers, a copy will need to beissued to the office as soon as the inspection is updatedQuarterly Inspections are done in house. Drivers are required to bring in their trucksonce a quarter. These are scheduled based off the date of your annual and given toyou upon hire. DOT inspections are a normal part of truck driving. If you get vehicle maintenanceviolations you will be required to bring your truck in for monthly review. DOT Roadside inspections will make your subject to disciplinary action and can result intermination depending on point valueTraining:Upon initial assignment to a company vehicle, the employee will go through a series ofTrainings that Include: Value Driven Driving, a review of ELD and HOS, and Ag exemptionsrules. DOT Regulations and Local HaulingThe operation of Hager Brothers is governed by the rules and regulations of theDepartment of Transportation. Hager Brothers, through its management team, believes inand strongly endorses these regulations. The management team and drivers shall adhereto these regulations. Furthermore, it is expected that every driver will familiarizethemselves with those regulations that apply to the operation their vehicle. If you have anyquestions, please contact your dispatcher for clarification.Local Hauling - The DOT does not require drivers hauling within a one hundred (100)mile radius of the base of operations to fill out log sheets unless they cross a state line.Following DistancePreventable collisions that result due to unsafe following distance will result in driversbeing subject to termination. Company policy requires all drivers to keep at least a 6 seconds following distance at alltimes under normal driving conditions. Under severe conditions, such as inclementweather or road construction, all drivers must increase this following distance at least 1second for each 10-mph. Speed Limits Hager Brothers maximum speed limit is 70 miles-per-hour. In addition, all state, county,and municipal speed limits will apply. Convictions on any speeding tickets issued by lawenforcement will result in the following penalties:First offense – written warning, insurance probation contractSecond offense – terminationGeneral Safety for VehicleIf you feel you cannot drive safely for any reason, notify your dispatcher or administrator. Non CompeteFor a period of 1 year from the date that Employee is no longer employed by the Company,Employee or Owner Operators shall not take any actions to assist Employee's successoremployer or any other entity in recruiting any other employee who works for or is affiliatedwith the Company.
Information:. Hager Brothers Trucking, Inc. is required to check the driving and employment history ofthe applicant for the previous three years. The company will conduct a road test if theapplicant does not have 2 years experience in hauling the commodities. The test willinclude: 1) a pre-trip inspection; 2) coupling and uncoupling; 3) placing the vehicle inoperation; 4) using the vehicle's controls and emergency equipment; 5) driving in traffic; 6)turning; 7) braking and slowing without using brakes; 8) backing; and 9) parking.A physical examination is required per section 391.41. The physical exam form mustinclude specific information and the medical examiner must be qualified to conduct anexam required by the Federal Motor Carrier Regulations. A certificate of medicalexamination will be given upon completion of the examination and a copy is required to begiven to the office. In addition to the required Motor Vehicle Report, Hager Brothers will run an initial Pre-Employment Screen on the employee with a signed consent in their DQ file. Drug & Alcohol Testing:A file is kept for all alcohol & drug related information. Drivers are subject to randomtesting. Drivers have to respond immediately after notification to get their testing done.In addition to the required Drug screen, Hager Brothers requires driver to be registeredin the FMCSA Clearing House and give consent for a Pre-Employment Query. HagerBrothers will also run a limited Query on a yearly basis in ordinance with the FMCSA.These regulations are subject to change and Hager Brothers will always strive to be incompliance with the FMCSA and DOT. More detailed information can be found in the Drug and Alcohol Policy found in the backof this book.
Mandatory Meeting/Inspections :Drivers are responsible to be at all of the following, if they can't attend they need toschedule a make up with the staff. No Call, No show will result in a hold on your paycheck until the meeting is made up. Quarterly Meetings, Once a Quarter all drivers will meet. Details will be in your e-mail. Ifyou miss and have not made arrangements to make up ,we will hold your check.Additional Trainings, If drivers are assigned additional training due to displinary actionthey have 30 days to complete it.Annual Inspections: Does not have to be done in house ,but a copy of renewedinspection is due in the office on or before the due dateQuarterly Inspections, Done in house during time frame givenAnnual Review, Done on anniversary of hire or scheduled time PersonnelBelow states all requirements by DOT, Applications ,must be fully filled out. If there areblanks missed, personnel will ask for more information. Personnel qualification requirements can be found in sections 383 and 391 of FMCSAcompliance. Accident Handling and Reporting Stop your vehicle and protect the scene. You do not want a secondary accident tooccur. 1.Call for medical assistance/assist the injured to the best of your ability 2.Call the police and the company as soon as possible. 3.Never admit fault or apologize. Apologies could be interpreted as anadmission of fault. 4.Locate witnesses and get important information from them. If possible, get names,addresses and phone numbers. 5.Exchange necessary information with other drivers. Never argue with other drivers,witnesses or police. 6.Take photos of the accident. One from every angle. 7.Never make a statement to the media. Refer them to the company. Always report theincident, no matter how small it seems, to a company supervisor.8. Accident Investigation: Accident investigation will be handled internally or through the use of police reports andfindings. All reports and photographs should be turned in as soon as reasonably possible.The supervisor along with the Fleet Manager will determine accident preventability and theproper course of disciplinary action, if any action is necessary. Disciplinary actions canrange from training to termination. The Insurance company also does an investigation. Ifthe accident puts a driver on the probation or rejected list, Hager Brothers will discussramifications with the insurance company. This can lead to drivers becoming uninsurablegiving Hager Brothers no choice but to terminate employment.
Roadside Inspection Fine/BonusIn attempt to encourage proper Vehicle Maintenance, Fines and Incentives duringroadside inspections are listed below. If you receive any of the following, the fines are stated. HOS - $150Vehicle Maintenance – $150Unsafe driving - $100 If you receive a roadside inspection and have no violations you will get the following as abonus check. Inspection Level: I – Full $150Inspection Level: II – Walk- Around $125Inspection Level: III – Driver $100Please note: All roadside inspections must be turned in. It is the law that youinform the carrier. Media Hager Brothers is aware of the growing popularity of social media ,but we alsoneed all drivers and owner operators to be aware of the risk. Social Media is acommon place for scammers and criminals. We strongly discourage postingpersonal information as well your location while on the road. Points Break Down:The following are considered major violations and will equal 6 points and resultin termination:The following are points assigned to specific violations. Point values may be added orchanged at anytime by Hager Brothers Trucking. A points sheet will be filled out uponyour Pre-Employment MVR and kept in your employee file. Points will be added if violations were found in the last 24 months. Points will also beadded at Annual Review meetings if violations are found. Lastly, Points will always beadded after DOT inspections, Accidents, or any tickets are issued to the driver. Drivers can call the office at anytime to find out point values. 6 points will result in automatic termination. Points assigned for any reason will resultin training and probation decided on by the Safety officer.
Drug & Alcohol PolicyCommercial Driver Program
Purpose StatementThe purpose of Hager Brothers Construction, Inc Drug & Alcohol Policy is to create,encourage and enforce a safe working environment for all employees and to protect thegeneral public from the dangers of substance abuse.Scope of TestingDOT Drivers: Testing will occur in five instances: Pre-Employment, Post-Accident,Reasonable Suspicion, Return to Work and Random Testing. These tests will screen forillegal drugs and/or alcohol (which are outlined in section Substances to be Screened).Alcohol PolicyThe consumption, purchase, sale or use of alcohol by any employee during work hours or onany work site is STRICTLY PROHIBITED. Alcohol abuse is serious and contributes toaccidents and life threatening conditions/accidents. If you have an alcohol abuse problem,contact your supervisor or the Drug and Alcohol Program Administrator. Assistance inlocating an appropriate treatment center shall be provided. Any employee who voluntarilyseeks treatment for an alcohol abuse problem shall not be discriminated against.Drug PolicyThe consumption, purchase, sale or influence of illegal drugs by any employee during workhours or on any work site is STRICTLY PROHIBITED. Illegal drugs are not only against the law,they can contribute to life threatening conditions/accidents. If you have a drug abuseproblem, contact your supervisor or the Drug and Alcohol Program Administrator. Assistance in locating an appropriate treatment center shall be provided. Any employeewho voluntarily seeks treatment for a drug abuse problem shall not be discriminatedagainst.Substances to be Screened
Collection Facility ProceduresPre-Employment Testing Procedure Prospective employees shall be given an appointment time by the hiring supervisor and directed to acollection facility. Failure to comply will be seen as an admission of guilt and will result in termination ofemployment. Positive Test or refusal to test will result in permeant ban of applicant getting hired onto HagerBrothers Trucking Reasonable Suspicion Testing Procedure An employee may be required to submit to a drug and alcohol test if there is reasonable suspicion that theemployee is under the influence of drugs and/or alcohol. The employee’s supervisor shall immediately notify theProgram Administrator if suspicious behavior is observed. A Safety Department representative shall bedispatched to observe and document the alleged suspicious behavior. The trained representative shall makethe determination if a drug and/or alcohol test is necessary. Reasonable causes include (but are not limited to):Incoherent, slurred speech, Odor of alcohol on the breath, Staggering gait, disorientation, or loss ofbalance, Red and watery eyes, if not explained by environmental causes, Paranoid or bizarrebehavior, Unexplained drowsinessIt is the responsibility of an employee to notify a supervisor if they are taking a legal prescription medication thatcould result in side effects such as those listed above. A letter from a physician detailing work restrictions mustbe submitted to the supervisor of any employee that is taking a doctor’s prescribed medicine that could impairthe employee’s physical and mental condition.Post Accident Testing ProcedureAny employee that is involved in an accident caused by that employee’s negligence, carelessness, inattentionto proper safety protocols or unsafe conduct resulting in preventable property damage or bodily injury will berequired to submit to a drug and/or alcohol test. The test shall be administered immediately following theincident/accident. Should the employee be unable to take the test immediately, the test must be conductedwithin thirty-two hours of the incident.Random Testing ProcedureDOT Drivers: As mandated by the Department of Transportation (Title 49: Transportation Part40), all DOTDrivers shall be enrolled in a random drug testing pool which is administered by a neutral third party. On aquarterly basis, the Program Administrator will receive a randomly selected list detailing the employees thatmust submit to a drug and/or alcohol test. Employees shall be asked to report to a collection facility by theirsupervisor at a convenient time. The employee must report to the collection facility at scheduled time. Failure to report to a collection facility will be recognized as a positive result with the employeesubject to all DOT ramifications and company disciplinary procedures, up to and including termination. All random tests must be completed within the three month time allowance. Employees may be selectedmore than once for random testing.Postive Result/Clearing house Prospective employees will be checked in FMSCA Clearing house as well pre employment checks. If Applicanthas positive test in last 5 years, applicant will not be accepted. A positive result on Pre-employment drugscreen will result in a ban from hire onto Hager Brothers Trucking.DUI/DWI If applicant has DUI/DWI in past 5 years, employment will not be available to prospective employee. If currentemployee gets a DUI/DWI this will result in immediate termination. Postive Result: Random, Post-Accident or Reasonable Suspicion Current employees who test positive for Random, Post-Accident or Reasonable Suspicion cannot reapply forfive years from the positive test date. This will be at the discretion of the Motor Carrier. 1) Removed fromSafety Sensitive positions immediately. 2) Provided a list of SAP professionals. 3) Cannot reapply foremployment for five years from the positive testing date.
Collection of SpecimenAt the collection facility, a laboratory technician shall give the employee directions on urine samplecollections. For monitored collections, a technician shall watch the collection of the urine specimen.. Consequences of Refusing to Test and Altered Samples for instances where a monitored collection isrequired, will result in a failure to comply with Hager Brother Policy and termination. At this time, theemployee shall disclose any medication (prescription or non-prescription) currently being used that may alterthe test results.Testing ProcessDOT Drivers: The Department of Transportation mandates that the collection facility sends all urinesamples to a certified testing laboratory. There the sample will be tested in accordance with the Departmentof Transportation Title 49 Part 40 (Procedures for Transportation Workplace Drug and Alcohol TestingPrograms). A Medical Review Officer (MRO) working for the certified laboratory will inform Hager BrothersTrucking, Inc. of the test results.Consequences of Refusing to Test and Altered SamplesIf a company employee refused to test, leaves a collection facility without submitting a specimen, or if asample is diluted or altered in any way; it will be treated as a positive test. Refusal to test includes (but is notlimited to): Failure to appear at test-site, failure to remain until test is completed, failure to provide a urinesample, failure to permit monitored collection (should it be required), and failure to cooperate with any partof the test process.DOT Drivers: In accordance with the Department of Transportation Regulations, employees whosesamples have been diluted or altered in any way will be required to submit to a second test. This test will beadministered as soon as possible and with no prior warning; the second test may be monitored collection. Unless the employee has a documented medical condition or is taking medication that would dilute orotherwise alter their urine specimen in any way, the employee will be terminated should their second testresult in another diluted test.It is the employee’s responsibility to read, understand and comply with all rules and regulations set forth inthis program.
