Encore at Harmony Covenants, Conditions, and Restrictions FAQ All homes within the Encore of Harmony community are subject to the recorded Declaration of Covenants, Restrictions, and Easements (CCRs) for the overall Harmony Community recorded on December 21, 2023, in Book 16759 on Page 149 in the Cabarrus County Register of Deeds records. The homes are also subject to the Recorded Declaration of Covenants, Restrictions and Easements for Encore at Harmony recoded on December 22, 2023, in Book 16762 on Page 0001. This document contains a brief summary of the key points concerning age restrictions in this document. Because Encore at Harmony is an age-qualified community, there are occupancy restrictions. Who is a qualified occupant? A qualified occupant must be 55 years of age or older. One qualified occupant is required to be a permanent resident for each home in Harmony. A permanent resident considers the home their legal residence and resides there for at least six months every calendar year. Other occupants must be 25 years of age or older. What occupancy restrictions are there? Children under 18 can stay no more than 50 times overnight in a 12-month period. Adults aged 18- 24 can stay no more than 90 times overnight in a 12-month period. Homeowners may provide care or supervision to children under the age of 18 as long as no compensation is given and there are no more than 50 overnight visits in a 12-month period. Are there any exceptions to occupancy to the age restriction? Exceptions to the age restrictions will be considered on a case-by-case basis by the board while complying with the HOPA Exemption under the Fair Housing Acts. How are changes in occupancy handled? In the event of any change in occupancy, such as a transfer of title, lease, death, etc., the homeowner must provide notice within ten days to the board with the names and ages (and any required information to reasonably verify ages) of all persons who will be residing in the home. Failure to do so allows the board to levy fines. Who is responsible for monitoring compliance with the age restrictions in the CCRs? The Association will maintain age records on all community residents and monitor and maintain compliance with the age restrictions. Homeowners agree to provide any required documentation annually to show compliance. Are there restrictions on the number of people living in each home? The number of people allowed to live in a home is limited to the number of bedrooms plus one. Encore by David Weekley Homes communities are age-restricted. Are there lease restrictions? All leases are subject to the age restrictions in the community. All leases must be in writing and for at least a 12-month period. Lease agreements must include a statement in conspicuous type that the homes in Encore at Harmony are intended for the housing of persons 55 years of age and older and failure to comply with the age restrictions is a default under the lease agreement. The homeowner is responsible for providing the Association with a copy of a lease, a signed acknowledgment of the CCRs, and any documentation required by the Association to verify ages before the tenant's occupancy. What are the architectural restrictions? No alternations to a home's exterior, including fences, can be made without prior approval by the Architectural Review Committee. The Association will provide architectural guidelines and procedures for ARC requests. What are the Association's responsibilities for yard maintenance? The Association will only maintain the grass in the front and rear yards in addition to the plants, shrubs, and trees in the front yard. Grass in rear yards behind fences will be maintained with restrictions. There are no replacements for plants, shrubs, or trees for any reason. Please see exhibit B of the CCRs for further details. What are the initial community rules and regulations? The Association has set the initial rules and regulations for the community, and they are outlined in exhibit C of the CCRs. These rules and regulations are subject to change. What are the Homeowner dues? Homeowners pay an annual assessment to the Association beginning at closing. Before the beginning of the fiscal year, the board prepares and approves the budget and sets the assessment amount for the coming year. Assessments are currently set at $240, billed monthly. This is subject to change each year. A one-time capital contribution is due to the Association when the home is purchased. This amount is set by the board. Currently, the amount is $1,200. This is subject to change.
