DECEMBER 2023 • CANADIAN PETROLEUM CONTRACTOR • 7 In today’s world, businesses face increasing environmental risks and liabilities. The potential for pollution in-cidents, hazardous waste exposure, and other environmental hazards can have severe consequences, both -nancially and legally. That’s where environmental insurance comes in. Environmental insurance, also known as pollution liability insurance, is designed to protect businesses from the nancial burden of environmental claims and cleanup costs. In this article, we will explore the importance of environmental insurance for businesses and the key reasons why it should be considered an essential part of risk management.Understanding Environmental InsuranceEnvironmental insurance is a specialized type of coverage that provides protection for businesses against liabilities arising from pollution incidents and environmental damage. It helps cover the costs associated with cleanup, legal expenses, property damage, and bodily injury resulting from pollution events. While general liability and property insurance policies may provide some cover-age, they often exclude or have limited coverage for pollution-re-lated claims. Environmental insurance fills this gap and provides comprehensive protection for businesses. The Need for Environmental InsuranceEnvironmental risks can arise in various industries and sectors. Businesses involved in manufacturing, construction, waste man-agement, healthcare, and many others may face potential pollu-tion exposures. Compliance with environmental regulations is crucial, as failure to do so can lead to significant fines, penalties, and legal actions. Environmental insurance helps mitigate these risks and ensures that businesses have the financial resources to address any environmental liabilities that may arise. The Cost of Environmental ClaimsEnvironmental claims can be complex and costly due to the nature of cleanup efforts and potential long-term impacts on the envi-ronment. For example, a spill of hazardous chemicals can result in extensive cleanup costs, legal expenses, and damages to sur-rounding properties. In some cases, businesses may be responsi-ble for monitoring and mitigating the effects of the pollution for years after the incident. Without environmental insurance, these costs can be overwhelming and potentially bankrupt a business.Increasing Awareness and Importance of Environmental InsuranceIn recent years, there has been a growing focus on environmental and social governance. Businesses are expected to demonstrate their commitment to environmental sustainability and responsi-ble practices. This increased awareness has led to a greater em-phasis on environmental insurance as part of risk management strategies. Investors and stakeholders are placing more impor-tance on companies’ environmental performance, making envi-ronmental insurance a vital component of global operations. The Importance offor businessesEnvironmental InsuranceBy David Mason, B.Comm., FCIP, CRMCanada Brokerlink

8 • CANADIAN PETROLEUM CONTRACTOR • DECEMBER 2023Types of Environmental Insurance CoverageEnvironmental insurance offers various types of coverage tailored to specific industry needs and environmental exposures. Here are some common types of environmental insurance coverage:Contractors Pollution Liability InsuranceContractors Pollution Liability (CPL) insurance provides coverage for contractors involved in construction, excavation, and other activities that may generate pollution risks. It protects against liabilities arising from on-site pollution incidents, including bodi-ly injury, property damage, and cleanup costs. CPL insurance is essential for contractors working with hazardous substances or in environmentally sensitive areas.Site Pollution Liability InsuranceSite Pollution Liability insurance is designed for property owners, developers, and operators of facilities where pollution risks are present. It covers liabilities related to pollution incidents that occur on or emanate from a specific site. Site Pollution Liability in-surance helps protect against claims for property damage, bodily injury, and cleanup costs associated with pollution events.Environmental Impairment Liability InsuranceEnvironmental Impairment Liability (EIL) insurance provides cov-erage for businesses involved in activities that may cause envi-ronmental damage, such as manufacturing, waste management, and chemical production. EIL insurance helps protect against li-abilities resulting from pollution incidents, including third-party claims, property damage, and cleanup expenses.Underground Storage Tank InsuranceUnderground Storage Tank (UST) insurance is specifically de-signed for businesses that store hazardous substances in under-ground tanks, such as gas stations, fuel distributors, and chemical storage facilities. UST insurance provides coverage for liabilities related to leaks, spills, and other pollution incidents involving un-derground storage tanks.Transporter’s Pollution Liability InsuranceTransporter’s Pollution Liability insur-ance is essential for businesses involved in transporting hazardous materials. It covers liabilities arising from pollution incidents during the transportation of haz-ardous substances, including spills, leaks, and accidents. This coverage is crucial for businesses in the transportation and logis-tics industry. The Benefits of Environmental InsuranceFINANCIAL PROTECTIONOne of the primary benefits of environmen-tal insurance is the financial protection it provides to businesses. In the event of a pollution incident or environmental claim, the insurance policy covers the costs of cleanup, legal expenses, property damage, and bodily injury. Without insurance, business-es would be responsible for bearing these costs themselves, which can be financially devastating.COMPLIANCE WITH ENVIRONMENTAL REGULATIONSEnvironmental insurance helps businesses meet their obliga-tions under environmental regulations. By having appropriate insurance coverage, businesses demonstrate their commitment Contractors Pollution Liability insurance is essential for contractors working with hazardous substances or in environmentally sensitive areas. In recent years, there has been a growing focus on environmental and social governance. Businesses are expected to demonstrate their commitment to environmental sustainability and responsible practices.

DECEMBER 2023 • CANADIAN PETROLEUM CONTRACTOR • 9 to environmental responsibility and risk management. Com-pliance with environmental regulations is not only a legal re-quirement but also an essential aspect of maintaining a posi-tive reputation and attracting investors.PEACE OF MINDEnvironmental risks can be unpredictable and costly. Having environmental insurance gives businesses peace of mind, knowing that they are protected in the event of a pollution incident or environmental claim. With insurance coverage in place, businesses can focus on their core operations without the constant worry of potential environmental liabilities.ENHANCED BUSINESS OPPORTUNITIESIn today’s business landscape, many clients and customers prioritize environmental sustainability and responsible prac-tices. Having environmental insurance can give businesses a competitive edge by demonstrating their commitment to en-vironmental protection. It enhances their reputation and can open doors to new business opportunities with environmen-tally conscious partners.Factors Affecting the Cost of Environmental InsuranceThe cost of environmental insurance varies based on several factors, including:Industry and type of business: Some industries inherently have higher pollution risks than others, impacting the cost of insurance.Size and scale of operations: The scope and scale of business opera-tions influence the potential exposure to pollution risks, affecting the insurance premium.Location: Businesses operating in areas with higher environmental sensitivities or stricter regulations may face higher insurance costs.Claims history: A business’s past claims history, particularly related to environmental incidents, can impact the cost of insurance coverage.Risk management practices: Demonstrating effective risk manage-ment measures and environmental compliance can help lower insur-ance costs. It is important for businesses to work with an experienced insur-ance professional who can assess their specific needs and provide tailored coverage options at competitive rates.ConclusionIn an increasingly environmentally conscious world, businesses must prioritize environmental risk management. Environmental insurance plays a crucial role in protecting businesses from the financial and le-gal consequences of pollution incidents and environmental liabilities. By having appropriate coverage, businesses can ensure their ability to handle cleanup costs, legal expenses, property damage, and bodily injury resulting from pollution events. Environmental insurance pro-vides financial protection, helps businesses comply with environmen-tal regulations, and enhances their reputation in the market. It is an essential component of risk management and should be considered a fundamental part of any comprehensive insurance program.

DECEMBER 2023 • CANADIAN PETROLEUM CONTRACTOR • 11 INTRODUCTIONEnsuring workplace safety is crucial for any organization. To simplify safety engagement and streamline the process of Job Safety Analysis (JSA), POST has introduced its new JSA Evaluation tool. This user-friendly tool aims to make safety assessments easier and more straightforward for users, addressing the concerns raised by previous com-plex and cumbersome documentation. In this article, we will explore the im-portance of JSA evaluation, how to effec-tively utilize the new tool, and the ben-efits it brings to both supervisors and work crews.IMPORTANCE OF JSA EVALUATIONPerforming regular JSA evaluations is es-sential to identify and mitigate potential hazards in the workplace. By conducting JSA Quality Assessments, organizations can ensure that safety protocols are fol-lowed, and employees are equipped with the necessary information and resources to carry out their tasks safely. POST rec-ommends a minimum of one JSA Quality Assessment per work crew per month to maintain a proactive approach to safety.SIMPLIFYING THE JSA EVALUATION PROCESSPOST’s new JSA Evaluation tool simpli-fies the process of assessing job safety by providing a user-friendly interface and straightforward evaluation criteria. The tool allows users to score their JSA based on three categories: meeting expectations (score of 3), partially meeting expectations (score of 2 with room for improvement), and not meeting expectations (score of 1). This scoring system provides a clear framework for evaluating the effectiveness of JSAs.UTILIZING THE COMMENT SECTIONTo provide further context and justification for the assigned score, users can utilize the comment section in the JSA Evaluation tool. This section allows them to explain specific observations or circumstances that influenced their scoring decision. For example, a score of 3 could be given when updating the JSA to reflect changes in work scope, while a score of 2 might in-dicate that feedback was not actively solic-ited during the JSA review process. A score of 1 could be assigned if the JSA lacks the signatures of the entire crew involved in the task.IMPLEMENTING JSA EVALUATION AT THE JOB LOCATIONTo effectively utilize the JSA Evaluation tool, it is important to incorporate it into the workflow at the job location. When approaching a job location, it is crucial to stop, observe work activity, and identify POST’s new JSA POST’s new JSA Evaluation tool Evaluation tool will make safety will make safety engagement simple!engagement simple!NEWS FROMNEWS FROMPOSTPOSTPOST’s JSA Evaluation tool provides the ability to track JSA quality leading indicators by contractor or project
