I UNDERSTAND THE PURCHASE OF THIS CONTRACT IS NOT REQUIRED TO OBTAIN FINANCING FOR THIS EQUIPMENT I HAVE READ UNDERSTAND AND ACCEPT ITS CONDITIONS THE ADMINISTRATOR MUST BE CONTACTED PRIOR TO THE PERFORMANCE OF ANY REPAIR THE ADMINISTRATOR WILL NOT BE RESPONSIBLE FOR ANY REPAIRS THAT ARE NOT PRE AUTHORIZED SEE YOUR RESPONSIBILITIES SECTION FILING A CLAIM FOR INSTRUCTIONS TO BE FOLLOWED IN THE EVENT OF A COVERED BREAKDOWN IF YOU SELL YOUR VEHICLE AND WANT TO CANCEL THIS CONTRACT YOU MUST REQUEST A REFUND IN WRITING ACCORDING TO THE TERMS IN THE CANCELLATION SECTION AT THE BOTTOM OF THIS CONTRACT DEFINITIONS Administrator means the company that provides administrative services for this Service Contract Application means information in the Declaration Section the first page of this Service Contract It lists information regarding You Your Equipment Coverage selected and other vital information Breakdown means the complete and total failure of a part covered by this contract to perform its intended function s in normal service providing it has received all scheduled maintenance as recommended by the manufacturer dealer or in the Owners Manual Breakdown does not include the gradual reduction in operating performances caused by wear and tear where a failure has not occurred Leakage is defined as fluid droplets hanging from a component or fluid that has dripped to another component Seepage is defined as oil film or dust accumulation on the exterior of a component Important Seepage is a normal condition and warranty does not cover the cost of repair attempts Coverage refers to the component protection You have chosen Deductible means the amount You are required to pay as shown in the Application Section per repair for covered Breakdowns Failure means the inability of an original or like replacement part covered by this Service Contract to function in normal service Equipment means the Mower that is described on the Application Service Contract or Contract means this Service Contract that You purchased from Us to protect Your Vehicle We Us Our or the Company means the Manufacturer from whom You purchased this Contract who is obligated to perform under this Contract You and Your means the Contract Holder Manufacturer means Bad Boy Inc O E means Original Equipment parts that are installed during production The Company listed above agrees that this Service Contract covers the above described Mower and the repair or replacement following a Breakdown and applicable labor per industry recognized labor guides related to repair or replacement of such parts provided that the Contract Holder does not have insurance or manufacturer s warranty covering such repair or replacement The operation of this Service Contract will be concurrent in certain cases with any applicable Factory or Manufacturer s Warranty or particular provisions thereof The provisions of this Service Contract commence on the Original Purchase Date and continue until the Contracts Term has expired or the Covered Unit s Expiration Hours exceeds the Contract Terms whichever comes first We may cancel this Contract within 30 days from Our receipt if underwriting criteria are not met This agreement is insured by Plateau Casualty Insurance Company and administered by Strategic Administration Group In the event the Manufacturer ceases to operate is bankrupt or YOUR claim is not paid Contract WHAT THIS SERVICE CONTRACT DOES NOT COVER A This service contract does not cover defects caused by depreciation or damage caused by normal wear accidents improper maintenance improper use or abuse of the product alterations or failure to follow the instruction contained in the Owner s Manual for operation and maintenance THIS SERVICE CONTRACT WILL NOT PAY OR REIMBURSE YOU FOR GLASS LIGHT BULBS PAINT SEATS TIRES BATTERY PHYSICAL DAMAGE ACCESSORIES Parts that are not O E BBM ESC LENSES BLADES DECK ANTI SCALPING WHEELS SALES TAX EXHAUST SYSTEM THE NORMAL MAINTENANCE SERVICES AND PARTS DESCRIBED IN THE COVERED MOWER S MFR SCHEDULE RUST CORROSION DUST COVERS DRIVE BELTS OTHER NORMAL MAINTENANCE SERVICES AND PARTS INCLUDING BUT NOT LIMITED TO ENGINE TUNE UP WHEEL BALANCING FILTERS ALL FLUIDS SPARK OR DIESEL GLOW PLUGS 11 17

YOUR RESPONSIBILITES 1 Maintenance You must have Your Mower checked and serviced in accordance with the manufacturer s recommendations as outlined in the Owner s Manual provided by the manufacturer of Your Mower Failure to perform the required maintenance will result in denial of Coverage under this Contract Contract Holder must keep receipts showing dates hours and services performed and or materials purchased and furnish them to the repair Facility when presenting a claim Required maintenance service may be performed by any qualified service facility but the Authorized Dealer or his authorized representative must perform repairs or replacements provided under this Service Contract 2 Filing a Claim When You have a Breakdown a Be sure the Mower is protected from further damage b Bring your Mower To an Authorized Dealer immediately for repair or replacement of the covered part s If you need assistance call the Administrator 1 833 223 2691 1 833 BADBOY1 c Furnish the authorized repair facility with receipts evidencing the continuation of maintenance requirements d Prior to proceeding with repairs ensure that the authorized repair facility calls the Administrator at 1 833 223 2691 1 833 BADBOY1 and obtains authorization to proceed with repair IMPORTANT CONTRACT HOLDER ASSUMES ALL LIABILITY FOR PAYMENT OF REPAIRS THAT ARE NOT AUTHORIZED TO THE REPAIR FACILITY The Administrator reserves the right to inspect the covered Vehicle before performance of repair or replacement e Pay the applicable Deductible if any and all charges for service not covered by this Contract You are responsible for authorizing inspection or teardown of your Mower by the repair facility to determine the cause of failure if necessary If the failure is not covered by this Service Contract you will be responsible for these costs EXCLUSIONS Contracts will not pay for a Breakdown a due to or contributed to by rust corrosion foreign objects and or contamination of fuels fluids refrigerants or lubricants b due to misuse abuse or negligence c due to the lack of normal maintenance required by the manufacturer s maintenance schedule d due to or caused by improper servicing or repairs e due to the failure to maintain proper levels of oil coolant lubricants or fluids due to any cause f due to alterations installations or modifications that have been made to Your Mower that do not meet the manufacturer s original specifications or the use of Your Mower in a manner not recommended by the manufacturer this includes but is not limited to any custom or add on part all frame or suspension modifications emissions and or exhaust systems modifications or engine modifications g caused by collision fire theft freezing vandalism riot explosion lightning earthquake windstorm hail water flood falling objects acts of God or environmental damage h caused by a non Covered part i if the Hour meter of Your Mower has ceased to operate been altered disconnected or replaced and the Hours in any way do not accurately reflect the actual Hours of Your Mower j any Covered part if a Breakdown has not occurred or if the wear on that part has not exceeded the tolerances allowed by the manufacturer but which a repair facility recommends or requires be repaired in connection with a Covered Breakdown this includes any expense due to engineering upgrades k additional damage to Covered parts as a result of the failure to protect Your Vehicle from further damage when a Breakdown has occurred l incidental or consequential loss or damage that is the result of a Covered Breakdown this includes but is not limited to any liability whatsoever for economic loss damage or injury to persons or property resulting from a Breakdown further Coverage is similarly limited for the loss of use time profit inconvenience lodging food or any other incidental or consequential loss except as specifically provided for by Travel and Lodging Coverage This exclusion may not apply in some states which disallow the exclusion of incidental or consequential damages m Breakdowns that occur and or repairs made outside of the United States of America and Canada n storage charges freight or delivery charges for parts shop supplies or hazardous waste disposal o Diagnostic Fees and or costs associated with teardowns p The customer shall pay any charges for making service calls and or for transporting the mower to and from the place where the inspection and or warranty work is performed BBM ESC 11 17
