BASA Bullen Issue 994New hazard classes are being proposed by the European Commission for inclusion into the Classicaon, Labelling and Packaging regulaons (CLP).IntroduconThe European Commission has issued a consultaon on a dra new Regulaon that would introduce new hazard classes as part of a revision of the Regulaon (EC) No 1272/2008 (the CLP Regulaon) on classicaon, labelling and packaging of substances and mixtures (CLP Regulaon).This consultaon opened on the 21st September 2022 and closed on the 18th October 2022. We will update members when the results of the consultaon come out.The proposed amendments to the CLP Regulaon includes entries in Annex I Classicaon and labelling requirements for hazardous substances and mixtures to introduce new hazard classes for disruptors for human health and endocrine disruptors for the environment. Both the endocrine disruptors for human health and disruptors for the environment have Categories one and two with Category one and two for disruptors for human health are dened as “Known or presumed endocrine disruptors for human health” and “Suspected endocrine disruptors for human health”. In a similar fashion hazard classicaons for endocrine disruptors for the environment has two categories Category one “Known or presumed endocrine disruptors for the environment” and Category two “Suspected endocrine disruptors for the environment”. The proposal also includes hazard labelling for endocrine disruptors.Both the endocrine disruptors for human health and for the environment have been given Generic concentraon limits triggering classicaon of a mixture as either Carcinogen Category one or two. The proposal also includes proposals for classicaon of substances as• Persistent, Bioaccumulave and Toxic (PBT) or Very Persistent, Very Bioaccumulave (vPvB) properes; and• Persistent, Mobile and Toxic (PMT) or Very Persistent, Very Mobile (vPvM)Click here to read the rest of this arcle on the members area of the BASA website.New CLP Hazard ClassesGeneral ChangesThere is only one new UN number: UN3550 COBALT DIHYDROXIDE POWDER, containing not less than 10 % respirable parclesThe UN number 1169 has been deleted and the entry for UN number 1197 has been amended to read: “1197 EXTRACTS, LIQUID, for avour or aroma”. There are also new special provisions 396, 397, 398 and 676.Chapter 1 changesWithin Chapter 1 there have been a number of changes to the denions, they have either been updated, deleted or added. There are new paragraphs;• 1.1.4.7 Rellable pressure receptacles authorized by the United States of America Department of Transportaon• 1.1.4.7.1 Import of gasesRellable pressure receptacles authorised by the United States of America Department of Transportaon and constructed and tested in accordance with standards listed in Part 178, Specicaons for Packagings of Title 49, Transportaon, of the Code of Federal Regulaons accepted for carriage in a transport chain in accordance with 1.1.4.2 may be carried from the locaon of the temporary storage at the end point of the transport chain to the end user. • 1.1.4.7.2 Export of gases and empty uncleaned pressure receptaclesRellable pressure receptacles authorised by the United States of America Department of Transportaon and constructed in accordance with standards listed in Part 178, Specicaons for Packagings of Title 49, Transportaon, of the Code of Federal Regulaons may be lled and carried only for the purpose of exporng to countries which are not Contracng Pares to ADR provided the following provisions are met:The lling of the pressure receptacle is in accordance with the relevant requirements of the Code of Federal Regulaons of the United States of America;The pressure receptacles shall be marked and labelled in accordance with Chapter 5.2;The provisions of 4.1.6.12 and 4.1.6.13 shall apply to pressure receptacles. Pressure receptacles shall not be lled aer they become due for periodic inspecon but may be carried aer the expiry of the me-limit for purposes of performing inspecon, including the intermediate carriage operaons.”Chapter 1 also sees the addion of three new new transional measures:• “1.6.5.23 EX/III vehicles rst registered or entering into service before 1 January 2029, in accordance with the requirements of 9.7.9.2 applicable unl 31 December 2022, but which do not conform to the requirements of 9.7.9.2 applicable as from 1 January 2023, may connue to be used.”• “1.6.5.24 FL vehicles rst registered or entering into service before 1 January 2029, which do not conform to the requirements of 9.7.9.1 applicable as from 1 January 2023, may connue to be used.”• “1.6.5.25 FL vehicles rst registered or entering into service before 1 January 2029, which do not conform to the requirements of 9.7.9.2 applicable as from 1 January 2023, may connue to be used.”Far more detail has been added on the obligaons of the competent authority and the obligaons of the inspecon Transport changes ADR 2023bodies in ADR 1.8.6.2 and ADR 1.8.6.3ConclusionsThis is NOT all of the proposed changes, just a selecon of the most relevant changes — you MUST check the regulaons or ask your Dangerous Goods Safety Advisor (DGSA) if you are unsure of the regulaons. We are working hard to stay on top of both the EU chemicals and products regulaon as well as the UK regulaons now that we have le the EU. It is certainly very challenging, and we are already starng to see both accidental and deliberate divergence from EU decisions. Product related regulaons are mainly focussed on construcon products at the moment, although we keep a close eye on food contact issues as well. UKCA marking connues to be a nightmare with government making comments that we have all had two years to prepare, without acknowledging that without a UK Approved Body, axing UKCA marking is not possible. The legal advice remains that because the legislaon sll has not been changed, that without a UKAB report or cercate, manufacturers should only ax CE marking. However, retailers will Regulatory Updatenot easily accept this argument when they are being told that from 1st January 2023 all products should have UKCA marking, despite this NOT being in the legislaon!UKREACH is also a huge issue for Downstream users, with the much smaller UK market size for substances and lack of UK substance manufacturers pushing all the expense and obligaons on downstream users who will all become rst me REACH registrants unless changes are considered. BASA in conjuncon with many other chemical associaons fear that many substances and products will disappear from the GB market, and in fact there is a very real fear that some EU adhesives and sealants manufactures may look to supply end users directly to avoid UKREACH obligaons.Please take a look on the BASA members area for important issues like the Substance watch list, the Biocidal Products watch list, the UKCA Marking Advice and also the new BASA Issues Map.
