FROM THE PRESIDENT Monte Vines My Theme for the WBA this Bar Year As I stated in my installation speech I decided to set a theme for the WBA this year This theme is inspired by the classic line from President Kennedy s Inauguration speech but tailored to fit the WBA Ask BOTH what your Bar Association can do for you AND what you can do for your Bar Association For decades the WBA has been in an enviable position among voluntary bar associations across the country with a high percentage of local lawyers being members and a high degree of engagement in WBA activities by our members There are many reasons for this strong history And there are many individual lawyers and many law firms whose efforts over the years made that happen But our membership numbers have been slipping over the past several years The total number of WBA members is down and just as important the degree of engagement in WBA activities by our members is also down The decline over the past year can be largely attributed to COVID and how it interfered with a number of WBA activities and with the law practices of many of our members But this problem predated COVID As we continue to emerge from the COVID restrictions on gatherings I hope that member engagement will also rebound as strongly It would be great to have a full house at the monthly Bar Luncheon meetings at our committee meetings at our social events and at our CLE seminars As for the theme it really just states the obvious that our Association is of great value to local lawyers in many ways and that value is created by our members many contributions to WBA activities and their engagement in these activities The first big job of a new WBA President is to make sure we have good leadership in place for each of our 25 standing committees I spent much of the month of June meeting with the chairs of each of those committees Most of our committees BAR O METER LITE AUGUST 2021 I have never served on so I had a lot to learn about the work of each of them I was very impressed with the chairs of our committees Chairing a committee is a great example of what you can do for your Bar Association Being actively engaged in one or more of our committees is a great way for a WBA member to both get value from their WBA membership and give value to the Association Our CLE seminars are another great example of how the WBA works well in its mutual relationship with our members We provide high quality local seminars in a wide variety of practice areas to help us stay current in our fields of practice and stay in compliance with the CLE Commission And we can provide them because we have members who are willing to step up and present the seminars One of the main areas of focus by the Board of Governors this year will be on membership The goal is to increase both membership numbers and member engagement in WBA activities Our Membership Committee will be a big part of that effort and will be developing ways to build up our membership and member engagement If you would like to be part of this effort please consider joining our Membership Committee Your insight on these matters would be helpful and greatly appreciated And the co chairs of that committee Samantha Woods and Joni Franklin will make it fun as well You can sign up to serve on the committee through this link https www wichitabar org page CommitteeInf Or just call the Bar office and they will sign you up Note you must be logged in to your profile to sign up for a committee Thank you for your membership and your engagement in our WBA activities You are what makes our Association one of the best bar associations in the country And remember Ask BOTH what your Bar Association can do for you AND what you can do for your Bar Association PAGE 2

IN THE 18th JUDICIAL DISTRICT OF THE STATE OF KANSAS REVISED Administrative Order 21 02 Order Revising COVID Protective Protocols in the 18th Judicial District Chief Judge Jeffrey Goering would like to personally thank the lawyers that have had business in the courthouse for the last 15 months for their patience and professionalism as we struggled to keep the court open and running through the COVID pandemic The cooperation of the bar has been invaluable and greatly appreciated by the bench This order replaces all previous Administrative Orders issued by Chief Judge Jeffrey Goering in relation to protective protocols put in place due to COVID 19 Issued on May 24 2021 Kansas Supreme Court Administrative Order 2021 PR 048 requires all district and appellate courts in Kansas to develop and follow minimum standard health protocols to avoid exposing court users staff and judicial officers to COVID 19 The chief judge in each of the state s 31 judicial districts is responsible for developing protocols for all courts within each district Each district must have a COVID 19 screening and communication protocol and the protocol must consider whether physical distancing and masking are necessary based on local health conditions After consulting with Dr Garold Minns Sedgwick County Health Officer Tom Stolz Sedgwick County Manager and Tania Cole Sedgwick County Assistant County Manager the following order is effective July 6 2021 1 In accordance with Centers for Disease Control Guidance issued on May 13 2021 all individuals including employees who are fully vaccinated are no longer required to wear masks or other face coverings except where required by federal state local tribal or territorial laws rules and regulations including local business and workplace guidance Should fully vaccinated individuals feel more comfortable wearing a mask they are welcome to continue doing so 2 Individuals including employees who are unvaccinated for any reason must continue to wear a mask or other face covering and social distance for their own health and safety and the health and safety of the public 3 Plexiglas in courtrooms may be removed at the discretion of the District Judge presiding in that courtroom Plexiglas in other District Court areas will remain 4 The requirement to wipe down all surfaces between hearings is removed However Courtrooms auxiliary areas used for trial proceedings and areas used for jury deliberations and breaks including restrooms eating areas stairwells and elevators will be routinely cleaned and sanitized by County janitorial services Hand sanitizer and disinfectant wipes will be provided in all areas used by jurors attorneys witnesses and other court personnel 5 Signage consistent with this administrative order and signage regarding cleaning and safety protocols shall be posted in English Spanish and Vietnamese in compliance with the Americans with Disabilities Act ADA BAR O METER LITE AUGUST 2021 PAGE 5

6 Upon request or on the court s own motion a judge may enter an order authorizing a waiver of the requirement to wear a mask or other face covering within the courtroom or other hearing room over which that judge is presiding Absent constitutional concerns judges should permit individuals to wear masks if they feel more comfortable doing so 7 Pursuant to 2021 PR 048 Courthouse Police shall complete COVID 19 screening measures for visitors in public entrances consistent with minimum standard health protocols either in writing verbally or through a combination of written or verbal communications These screening measures shall include communications that a if a person is not fully vaccinated against COVID 19 that person would need to wear a mask within the Courthouse and b any unvaccinated person who is experiencing COVID 19 symptoms or has been exposed to someone with COVID 19 within the last 14 days should contact Courthouse Police For any person described within subsection b such person will be denied entrance and given instructions about how to reschedule their court hearing Also a Vistor Alert notice should be posted at all entrances to all courthouses and all court offices 8 Limits on how many people can ride an elevator at the same time will be removed for vaccinated individuals Unvaccinated individuals should ride with no more than three other people in the same elevator Dated this 22nd day of June 2021 BAR O METER LITE AUGUST 2021 JEFFREY GOERING Chief Judge 18th Judicial District PAGE 6

Girls Just Wanna Have Fun By Candice Farha Although Covid continues to hamper in person gatherings members of the Kansas Women s Attorney Association s KWAA District F didn t let the virus ruin their fun Many Wichita and surrounding area women gathered for in person events during this year s virtual Lindsborg conference KWAA s 32nd annual conference titled Don t Stop Believin for this year s 80 s themed conference was an absolute hit Attendees enjoyed a variety of presentations everything from Worker s Compensation basics to Pranayama for Lawyers a yoga technique focused on breathing There was no shortage of creativity in the conference s presentations For example two of the speakers presented their materials from their place of practice in the U S Virgin Islands leaving attendees to ponder how they might move their own practices to the sunny locale One presenter parodied the admission video from Legally Blonde complete with a dive into a swimming pool Other presenters had a bit of fun with creative Zoom backgrounds On the first day of the two day conference women attorneys gathered at Martin Pringle s beautiful new facilities The day featured brunch from Homegrown afternoon pie from Peace Love Pie and snacks provided by Martin Pringle They ended the day with a happy hour at The Kitchen where they enjoyed appetizers and sangria along with delightful conversation On the second day the attendees gathered at Foulston Siefkin At lunch the Solo and Small Practice Group met at Lola s Bistro while the remaining attendees enjoyed Singapore Slings at P F Chang s The main event the traditional gala on the last evening of the conference was held at the Hinkle law firm The gala gals savored a taco bar and margaritas provided by Erica Lopez as well as cake from Bagatelle Miss Kansas 2019 Annika Wooton the keynote speaker spoke about the importance of picking yourself up and dusting yourself off as she had done seven times before winning Miss Kansas She then regaled the attorneys with a speed painting of the late Ruth Bader Ginsburg a talent she had performed on stage in 90 seconds The most touching and important part of the conference of course was the presentation of the annual awards This year s honorees included Justice Evelyn Wilson who received this year s Jennie Mitchell Kellogg Achievement Award JMKAA named for the first woman admitted to the practice of law by the Supreme Court of Kansas Natalie Haag received the Carol Foreman Medal of Civility named in memory of charter KWAA Member Carol Foreman The evening also included a nod to last year s virtual JMKAA recipient Gaye Tibbets featuring a video tribute filmed in her honor by her colleagues in the Wichita bar Overall fun was had by all that joined And while nothing can compare to the joys of Lady Lawyer Summer Camp in Lindsborg the in person presentations held by District F provided some familiar fun for those in attendance Now to start planning next years return to Lindsborg Gala attendees on the balcony of Hinkle Law Firm BAR O METER LITE AUGUST 2021 PAGE 7

Young Lawyers Section Update By T Chet Compton YLS President Ah the good ole day of being in the Young Lawyers Section Everybody has a story Okay maybe not everybody But the chances are good that if you ask an attorney who began their career here they will have a story or two to share about Trolley Trek the Salvation Army Christmas Party or monthly socials with their fellow Young Lawyers They might also have a story or two they are not willing to share The WBA website describes the Young Lawyers Section as focused on assisting the new attorney to life in the legal real world This is a true statement but don t mistake it with a chore Really what we do is have fun Food drink and comradery with peers is how the assisting is achieved Our monthly meetings are mainly how we get the job done We meet on the second Thursday of each month from September through May for an after work social at varying bars and restaurants There is typically at least one informative speaker at each meeting and most importantly the food and drink are on us Then there s Trolley Trek This is a prime example of our dedication to providing assistance to our fellow young lawyers This traditional marquee event typically occurs in October and involves renting a party bus and touring some of the finer drinking establishments around town Keep an eye out for sign up details because this one fills up fast And while we assist those within our own group we also take pride in our volunteer and philanthropic ventures as well The staple here is the Young Lawyers tradition of raising money for and putting on the Salvation Army Christmas Party The Big Bar helps make this one possible through their generous donations If you have never joined us at the Christmas Party with the families at the Salvation Army I highly encourage you to do so It is truly special Believe it or not that happens in December To everyone eligible to become a member of the Young Lawyers Section come join the fun And at the risk of stating the obvious the more you join us the more fun you have Meeting people is great but developing meaningful relationships through Young Lawyers will pay dividends to your practice immediately and will last a lifetime To those in the Big Bar I encourage you to encourage those eligible to get involved This is extremely important The almighty billable hour is fleeting when compared to the benefits attained through relationships built within the Bar After last year everybody is in need of assisting The Young Lawyers Board is excited to get back to doing just that To be eligible to join the Young Lawyers Section you must be a member of the WBA and either 35 years of age or younger or within the first five years of your practice If you have questions about becoming a member contact Lori Gardner at the WBA Keep an eye out for details on our first monthly meeting in September Details will be e mailed to all members of the Young Lawyers Section in August The stories we will tell years from now will be made this year I hope you will choose to be part of them YLS Board Members President Chet Compton Fleeson Gooing President Elect Megan Townsley McConnell Vice President Jeremy Koehler Foulston Secretary Amy Rider Fleeson Gooing Treasurer Tara Mollhagen Shepherd Bever Dye Social Chair Quentin Aker Martin Pringle Social Chair Clara Melero DeVaughn James BAR O METER LITE AUGUST 2021 PAGE 8

mek tim The competition was tough but not because opposing teams made up of bankers priests nuns and assorted other groups were such great spellers The Bee is a fundraiser for the Dear Neighborhood Ministries and donations can result in a team getting do overs easier words and tips But donations can also be made to take those same things away from a team Because the Bar Bees had won the last two Bees they were targeted Being targeted however was good for the cause as this was a record year for the fundraiser As teams were knocked out of the competition the Bar Bees looked strong successfully spelling obscure multiple syllable words like daguerreotype There were three teams in the finals Jennifer Magana was the designated speller for the Bar Bees Although the audience rooting for the Bar Bees thought Jennifer has won the event there was an announcement that it was a tie The Bar Bee fans could not balk too much however because most of them could not spell well enough to swear that Jennifer had won So the finals were redone This time Holly faced the crowd and quickly spelled a lot of big words Jennifer apparently suspicious that she had not previously been declared the winner counted the correctly spelled words on her fingers Finally a winner was declared It turned out the Finals were redone to break a tie between second and third place teams The Bar Bees won the Finals both times The Bar Bees their fans and Lady Justice The 2021 Bar Bees Stacy Ortega Joni Cole Holly Dyer and Jennifer Magana Quod est quod dixerunt That s What They Said WBA Members Share Their Memories of Past Spelling Bees What Was the Word that Caused You to Lose and or the Word that Cinched Your Win I was eliminated in the school wide spelling bee in third grade by larynx I had no idea what a larynx was and I certainly didn t know how to spell it To my credit I went with what I thought was a solid phonetic spelling but turns out l a r i n e x is incorrect Quentin Aker Martin Pringle Oliver Wallace Bauer L L P I was on the verge of capturing the spelling bee in 2nd grade when I misspelled biscuit Unfortunately my elementary mind didn t appreciate the snappy branding of Bisquick which was the box mom pulled out of the cupboard any time we had those floury circle thingies Aaron Breitenbach Sedgwick County District Attorney s Office Many many years ago I was selected to be in the Spelling Bee It was held in the old KFH Building which is the building across Market from the old Macy s parking garage It was one of the earlier sessions and we had lots of people on stage on risers so that we all fit on stage The moderator would go from contestant to contestant with a word to spell and being taller than most others I was on the third level riser and when my word came up the moderator asked the word and stuck the microphone toward my mouth I was nervous and moved backwards which caused me to fall off the riser No problem I got up spelled the word and went on for several rounds It was embarrassing to me and to my parents and those who heard of it in my school Eugene Field never let me forget Mel Gregory Attorney at Law I was on the 4 person team that won the KFH spelling bee in 1951 It was the team from Jefferson Elementary school Richard Honeyman Hite Fanning Honeyman L L P I was in my elementary school spelling bee every year In 4th grade I took second place to a 5th grader who was part of one of those spelling bee dynasty families and who once made it to the Scripps National Spelling Bee I lost on the word candelabra because who knows THAT word in fourth grade I won my 5th grade spelling bee no idea what word and went on to regionals and lost in the first round civilian I have never forgotten how to spell that word either In 6th grade I was unjustly ousted by a judge who misheard me add a wayward e to the end of the word eulogy which I spelled correctly and WHO PUTS AN E ON THE END OF THE WORD EULOGY ANYWAY Not that I m bitter all these years later Alas that was the tragic and fitting end to my once promising spelling bee career Sara Zafar Wichita State University I took second place in the spelling bee for my 5th grade class because I misspelled the word typhoon I knew typhoon was spelled with a ph but I ended what was sure to be a stellar spelling bee career by spelling it with an f instead I have yet to fully recover from the
