1. Your Project Summary Scope of Services • Shop drawings for structural steel for review and approval by the structural engineer. • Production and installation of structural steel including painting off site. • Demolition and levelling of site to new levels. • Under slab drainage for down pipe. • Electrical works in slab if required. • Concrete package including formwork, reinforcement, concrete placement. • Structural timber framing to engineer's detail. • Metal roofing and skylight installation. • Electrical rough in and fit off for new lighting, ceiling fans, and heaters. • Installation of ceiling linings • Grinding and sealing of topping slab. • Allowance to make good landscape areas. • Handover and maintenance package supplied. 2. Contract Budget • Proposed Contract Budget: $162,118.00 Excluding GST • No Contingency allowed, it is recommended that the client allow 10% contingency on top of the allowance. Although we work hard towards meeting the budget, every construction project carries risk of unforeseen expenses and cost escalation. 3. Construction / Renovation Works Agreement Terms Contract A contract for the construction works will need to be agreed following acceptance of this budget and project plan. We typically proceed with either a Cost Plus contract or a Lump Sum contract. We propose to offer either the standard Master Builders Association Cost Plus Contract or Lump Sum contract and can provide reference copies on request. In a cost plus contract Ballast Point will charge for the cost of the works including materials, trades, services and expenses, plus a margin for profit, risk and overheads. The cost plus contract provides our clients with flexibility in scope and budget where things can be added, adjusted and removed from the scope. In a cost plus contract the you as the client bear the cost risk. In a fixed price contract the builder bears the cost risk. The scope of works is fixed to the contract documentation and variations are issued if the scope is to vary from the documentation. Please note that is our policy that we do not allow deviations from standard form contracts. Margin The margin included in the subsequent contract is disclosed up front, and will be as per the following schedule: Claims We will invoice monthly based on work completed, plus costs for architecture team, external subcontractors, consultants and disbursements as outlined in this agreement. Payment Terms Payment terms are 7 days. Scope Changes & Additional Services Scope changes or additional services outside the scope of works defined in this agreement, will be charged at the hourly rates outlined in Section 7. Schedule of Labour Rates. Note that additions to the scope of works in trades will generally require additional management and administration so changes to trade attract an additional 20% in Preliminaries. HBCF Insurance Projects over $20k require a contribution to the Home Builders Compensation Fund (HBCF) which is a statutory provision of a safety net for home owners in NSW faced with incomplete and defective building work carried out. This amount is included under the ‘Preliminaries’ trade prefix if required. Disbursements All fees to authorities (Council, Government Agencies etc) will be paid by Ballast Point and charged at cost to the client. Travel time will be charged at cost + time charges as a disbursement. Courier and postage services will be charged at cost as a disbursement. 5. Agreement It is hereby agreed as follows: The Client agrees to engage Ballast Point subject to and in accordance with the terms of this Agreement and undertakes to carry out their duties in accordance therewith including payment of the fees and expenses as set out in the Agreement. The client must pay Ballast Point the fees plus GST in accordance with this Agreement, and understands that the hours in this proposal are an estimate only and agree with the rates that have been put forward. Ballast Point agrees to perform the services described in the agreement and in accordance with the terms and conditions hereunder. We have excluded contingency from the contract but it is advisable that the client allow 10% contingency. This document is a budget and not a contract for construction. Following acceptance of this budget, a formal contract for the works will be forwarded. 6. Schedule of Labour Rates This Schedule shown for information purposes relating to design work and construction work by Ballast Point. Notes: 1. Rates include margin and on-costs (super, payroll tax, workers comp, etc.). 2. GST is excluded in the above schedule, and will be included on claims. 3. Hours will be supported by timesheets signed off by appropriate manager. 4. A percentage margin will be added to all materials and subcontractors. This margin varies depending on type of contract used, and the value of the works. Refer to schedule of margins in section 7. 5. Payment terms – 7 days from invoice date. 6. These rates are subject to periodic review - changes will be notified in writing with 30 days notice. Geoff Kirk Construction Manager Geoff has more than thirty years' experience as a Carpenter, Site Manager and Project Manager. He understands project economics, risk management and how best to achieve clients objectives. He has completed a significant number of multimillion-dollar residential projects and has world for Sydney’s leading home builders including Bellevarde, Pimas Gale and Yuncken Builders. Geoff genuinely cares with about his clients, staff and everyone involved in each project and sets out to achieve the very best. He can operate on the most challenging sites in the most challenging circumstances and manage staff, subcontractors and neighbours with a steady hand at all times. Malik Ilyas Operations Manager Malik has been working at Ballast Point since 2015. He is a natural leader, incredibly conscientious and hardworking. Malik was sponsored by Ballast Point to get his Australian residency and bring his family from Pakistan in 2018 – something the company is truly proud of. Malik has never let a client down and never left a client unhappy, he goes the extra mile and then the extra ten miles as well. Malik has a Diploma in Administrative Management, Diploma of Business and Advanced Diploma of Business. Major projects he’s worked on include the redevelopment of the Red Truck Removals and Storage depot at Blacktown and the renovation of NWN Property in Epping.
